담마삿타

Dhammasattha ("treatise on the law") is the Pali name of a genre of literature found in the Indianized kingdoms of Western mainland Southeast Asia (modern Laos, Burma, Cambodia, Thailand, and Yunnan) principally written in Pali, Burmese, Mon or the Tai languages or in a bilingual nissaya or literal Pali translation (Burmese: နိဿယ). "사타"는 가르침, 학습 또는 학문을 위한 산스크리트어인 śstra를 가리키는 팔리어이다. Burmese ဓမ္မသတ် is often transliterated "dhammathat" and the Tai and Mon terms are typically romanized as "thammasāt" or "dhammasāt" (Thai: ธรรมศาสตร์) Dhammasattha texts are historically related to Hindu dharmaśāstra literature, although they are very significantly influenced by the Theravada Buddhist traditions and literature of Southeast Asia.

역사

함마타트라는 단어는 13세기 바간에서 나온 버마타 비문에서 처음 언급되고 있지만, 일찍이 함마타타 텍스트가 그곳으로 전달되었을 가능성이 있다. 어떤 닥마삿타들은 첫 천년에 편찬되었다고 주장한다. There are nine primary Burmese dhammathats, namely the Manu and Dhammavisala Dhammathats of the Pagan Kingdom, the Wareru Dhammathat^{[1]: 210} (1270), Pasedha (1468), Dhammathat Kyaw (1581), and Pyanchi Dhammathats (1614) of the Taungoo Dynasty, and the Myingun Dhammathat (1650) of the Konbaung Dynasty.^[2] 버마 연대기에서 언급된 최초의 닥마타트는 스리 크세트라 왕국 시대의 두타웅 닥마타타트다.^[3]

전통적인 버마법에서는 상호중재, 야자타트, 닥마타트 순이었다.^[3] 버마 닥마타트는 ameindaw(편집) 또는 팡단 형태의 해석적 지침으로 보완되었다.^[3]

특히 미얀마에는 함마삿타 엑세게시스의 광범위한 전통이 있다. 수백 개의 dammasatth, 논평 및 관련 법률 문헌이 파라바이크(팔름잎 필사본) 형태로 현존하고 있다.

법사

Dhammasatths는 식민지 시대 이전에 결혼, 절도, 폭행, 노예제도, 부채, 왕권, 재산, 상속과 관련된 문제에서 많은 동남아시아 사회에 영향을 미쳤다. 현대 버마에서는 식민지와 식민지 이후의 법률이 우세하지만, 가정과 상속법의 특정 영역에서 법정의 닥마타트를 사용하는 것은 여전히 용인되는 관행으로 남아 있다.
