School Prayer Amendment

학교 기도 수정안은 학생들이 원할 경우 자발적으로 학교에서 기도할 수 있는 권리를 보호하기 위해 제안미국 헌법 개정안이지만 반대론자들은 정부가 지원하는 기도를 허용한다고 주장합니다.

배경

Engel v. Vitale(1962)와 Abington School District v. Schempp(1963)의 경우, 미국 대법원은 정부가 의무화한 학교 기도가 수정헌법 제1조의 제정조항에 의해 위헌이라고 판결했습니다. 하지만 자발적인 기도는 위헌이 아닙니다.

학교 기도 개정의 역사는 1962년 엥겔 비탈레 대법원 사건에서 시작되었습니다. 뉴욕의 한 정책은 학교들이 매일 기도의 말씀으로 시작하도록 요구했습니다. 이 사건에 대해 휴고 블랙 판사는 "... 종교의 확립을 존중하는 법률에 대한 헌법적 금지는 적어도 이 나라에서는 정부가 진행하는 종교 프로그램의 일부로서 미국인들의 어떤 집단도 암송하기 위해 공식적인 기도를 하는 것이 정부의 일의 일부가 아니라는 것을 의미해야 합니다."

다음 해에 비슷한 사건이 일어났습니다. 애빙턴 타운쉽 학군 켐프. 이 사건의 영향은 공립학교에서 학교 관계자들이 기도회를 조직하거나 주도하는 것은 물론이고 예배를 주관하는 것을 금지한 것이었습니다. Abington v. Schempp는 학교 교수진이 종교를 신장시키거나 약화시켜서는 안 된다고 요구했습니다. 그 다음 대법원은 1985년 Wallace v. Jaffree 사건으로 학교 기도를 검토했습니다. 앨라배마 주의 침묵의 순간 법 개정안에는 침묵의 순간이 '명상 또는 자발적 기도'를 위한 것이어야 한다는 규정이 포함됐습니다. 법원은 이 같은 변화를 정부가 학교에서 기도를 추진하는 것으로 보고 법으로 변경한 것을 뒤집었습니다. 재판관들은 잠시 묵념하는 것은 적절하지만 어떤 종교적 목적을 위해서는 아니라고 설명했습니다.[1]

제1절 양심의 명령에 따라 하나님을 인정하는 국민의 권리를 확보하기 위하여: 학교를 포함한 공유재산에 대한 국민의 종교적 신념, 유산 또는 전통을 인정하고 기도할 권리가 침해되어서는 아니 됩니다. 정부는 종교를 이유로 어떤 사람에게도 기도나 기타 종교 활동에 참여하거나 학교 기도를 시작하거나 지정하거나 종교를 차별하거나 혜택에 대한 동등한 접근을 거부할 것을 요구해서는 안 됩니다.[2]

이 헌법에서 어떠한 것도 공립학교나 그 밖의 공공기관에서 개인이나 단체의 기도를 금지하는 것으로 해석되어서는 안 됩니다. 어떤 사람도 미국이나 어떤 주에서도 기도에 참여할 것을 요구하지 않습니다. 미국이나 어떤 국가도 그러한 기도의 내용을 규정해서는 안 됩니다.[3]

역사

1962년, 1973년, 1979년, 1982년, 1993년, 1995년, 1997년에 웨스트 버지니아주의 민주당 상원의원 로버트 버드(Robert Byrd)가 수정안을 제안했습니다.[4]

뉴욕타임스1999년 7월 당시 공화당이 다수를 차지하고 있던 하원이 오랫동안 이 같은 개정안을 발의해왔으나 헨리 하이드 당시 하원 법사위원장이 제안한 '종교의 자유'를 허용하는 경쟁적이고 보다 일반적인 개정안에 몰두하고 있다고 보도했습니다.[5] 1997년 5월 8일 오클라호마 제5의회 선거구 출신공화당 의원 어니스트 이스테이크(Ernest Istak)가 이 개정안을 발의했습니다.[6] 1998년 3월, 법사위는 이 법안을 16 대 11의 투표로 통과시켰습니다.[7] 1998년 6월 4일, 하원 전체가 224 대 203의 찬성으로 수정안을 표결에 부쳤습니다.[6] 이번 표결은 미국 헌법 5조가 개헌안을 발의하기 위해 요구한 3분의 2 과반에 61표가 모자랐습니다.[8]

저는 이 수정안을 1999년 하원 공동 결의안 66호와[9] 2001년 "종교 연설 수정안"으로 두 번 다시 의회에 제출했습니다.[10] 버드는 2006년 4월 29일 개정안을 다시 발의했습니다.[4]

발의된 개정안은 채택되지 못했지만, 동등 접근법 통과로 이어졌습니다.

2012년 대선 후보였던 릭 페리 텍사스 주지사는 2011년 12월 11일 폭스 뉴스 선데이 인터뷰에서 "저는 우리 아이들이 원할 때 언제든지 학교에서 기도할 수 있도록 하는 헌법 개정을 지지할 것입니다."[11]라고 말했습니다.

접수처

종교로부터의 자유 재단,[12] 미국 시민 자유 연합,[13] 미국 정교[14] 분리 연합은 모두 이 개정안에 반대를 표명했습니다. 가족 연구 위원회가 이를 지원했습니다.[15]

여론조사

1985년 여론조사에 따르면 61%가 학교 기도 수정안을 지지했습니다.[16]

2005년 갤럽 여론조사에서 미국인의 76%가 "헌법 개정"에 찬성하는 것으로 나타났습니다.[17]
