미국의 사법방해죄는 검사, 수사관 또는 다른 정부 관계자들을 방해하는 범죄로 구성되어 있다.미국 이외의 관습법 관할권에서는 정의의 진로를 왜곡하는 광범위한 범죄를 이용하는 경향이 있다.
방해죄는 위증, 공무원에게 허위 진술을 하는 행위, 증인 변조, 배심원 조작, 증거 인멸 등의 행위가 포함될 수 있는 광범위한 범죄다.협박이나 실제 신체적 위해를 가하는 수단을 통해 법원이나 공무원을 공공연히 강요하는 행위, 적법한 권위의 외모를 훼손하기 위한 법원 공무원에 대한 고의적 시위에 대해서도 업무방해죄가 적용된다.[citation needed]
법률 개요
사법방해는 다양한 특정 범죄를 포괄하는 포괄적 용어다.[1]블랙스 로 사전은 그것을 "법률과 정의의 질서 있는 행정과의 간섭"[2]이라고 정의한다.방해죄는 여러 출처별로 공정범죄,[3] 공공질서범죄,[4][5] 화이트칼라범죄로 분류돼 왔다.[6]
방해죄에는 판사, 검사, 법무장관, 선출직 공무원 등이 전반적으로 저지른 범죄가 포함될 수 있다.
합중국 연방법
연방법에서 사법방해죄는 주로 미국법 제18장 제73장에서 정의된다.[7][8]이 장에는 증인 변조 및 보복, 배심원 조작, 증거 인멸, 공정 서버 폭행, 법정 기록 도용 등 다양한 특정 범죄를 다루는 조항이 수록되어 있다.[9]또한 연방 법원, 의회 [10]및 연방 집행 기관의 절차 방해에 관한 더 많은 일반 섹션을 포함한다.[9]옴니버스 조항으로 알려진 이 장에서 가장 광범위한 조항 중 하나는 "부정적인" 자는...현재 진행 중인 법원 절차와 관련하여 적법한 사법행정에 영향을 미치거나 방해하거나 방해하려는 노력이 처벌 대상이다.[11]
사법방해 빈도에 대한 통계가 불분명하다.[12]2004년 연방기관은 446명을 방해죄로 체포했는데 이는 전체 연방 체포의 0.3%에 해당한다.[13]그러나 여기에는 더 심각한 기저 범죄 외에 방해죄로 기소된 사람들은 포함되지 않는다.[12]
양형강화
연방형량지침에 따르면 어떤 범죄로 유죄판결을 받은 피고인이 자신의 범죄에 대한 수사나 기소를 방해해 정의를 방해한 것으로 드러나면 더욱 중형을 선고받을 수 있다.[14][15]방해죄에 대한 별도의 유죄판결은 합리적인 의심을 넘어서는 증거가 필요하지만, 양형 목적의 방해죄의 발견은 "증거의 우월성"이라는 더 느슨한 기준만 충족하면 된다(강화된 형량이 기본 범죄에 대한 법정 최고 형량을 초과하지 않는 한).[16]
방해물 발견은 범죄자의 형량에 2단계를 추가하며, 이는 68개월의 추가 징역형을 초래할 수 있다.[17]2017년에는 연방법원에서 발부된 전체 형량의 2.1퍼센트를 차지하는 1,319건에 장애물 강화가 적용되었다.[18]
주법
사법방해에 관한 주법은 매우 다양하다.2004년 조사에 따르면 24개 주와 컬럼비아 구는 연방법에서 발견되는 것과 유사한 넓은 용어로 사법방해나 정부기능의 방해를 범죄로 규정하는 일반법령을 가지고 있다.[9]모든 주에는 증인 변조, 배심원 조작 또는 증거 인멸과 같은 특정 유형의 방해 행위를 금지하는 법이 있다.[9]
역사
1789년의 사법법에 의한 연방법원의 창설로부터, 법관은 법원을 모독하여 정의를 방해한 자를 약식적으로 처벌할 수 있는 권한을 가지고 있었다.[19][20]
1830년의 스캔들은 별도의 범죄로 경멸법의 개혁과 사법방해죄의 신설로 이어졌다.연방 판사 제임스 H. 펙은 펙의 의견 중 하나를 비판하는 편지를 발행한 것에 대해 모욕죄로 변호사를 투옥했다.이러한 남용을 막기 위한 노력의 일환으로 의회는 1831년 법원 내 또는 근처에서 자행된 범죄에 대해 요약 경멸 절차의 적용을 제한하는 법을 통과시켰다.오늘날 옴니버스 조항으로 존속하고 있는 새로운 조항이 추가되어 법원 밖에서 자행된 경멸을 처벌했지만, 이는 배심원들에 의한 기소와 재판을 거쳐야만 이루어졌다.[19][20]
1982년, 방해법이 범죄 피해자와 다른 증인에 대한 적절한 보호를 제공하지 못한다는 우려에 대해, 의회는 피해자 및 증인 보호법의 일환으로 증인 변조 및 증인에 대한 범죄화된 보복에 대한 법을 확대했다.[21]
사르베인-2002년 옥슬리법은 회계법인 아서 앤더슨이 엔론 스캔들과 관련된 문서를 파쇄했다고 널리 보도한 것에 대응하여 수사나 절차가 시작되기 전에 증거 인멸에 관한 법률을 강화했다.[22]
주목할 만한 예
- 1974년 리처드 닉슨에 대한 탄핵 절차에는 워터게이트 강도사건 수사를 방해한 혐의로 사법방해 혐의가 포함됐다.닉슨의 방해행위는 하원 법사위에서 주장한 바와 같이 수사관들에게 거짓말을 하고 증거를 원천징수하며 증인에게 영향을 미치고(묵시금 지급 포함), 수사에 대해 대중에게 허위 진술을 하는 등의 내용을 담고 있다.[23][24]닉슨은 탄핵 전에 사임한 것이 하원 전체의 고려 대상이 될 수 있었고, 어떤 범죄 수사도 일어나기 전에 제럴드 포드에 의해 선제적으로 사면되었다.[25]
- 이란-콘트라 사건 이후, 레이건 행정부의 몇몇 구성원들은 이 문제를 조사하는 의회 위원회에 거짓말을 하고 증거를 은폐하는 등의 혐의로 사법방해 혐의로 기소되었다.[26]
- 1998년 빌 클린턴의 탄핵안에는 클린턴이 폴라 존스가 자신을 상대로 제기한 성추행 소송에서 모니카 르윈스키 등 증인들의 증언에 영향을 미치려 하고, 르윈스키에게 증거를 은폐하도록 유도해 정의를 방해했다는 주장이 포함됐다.[27]클린턴은 상원에서 모든 혐의에 대해 무죄를 선고받았다.

- 딕 체니 부통령의 고문인 스쿠터 리비는 2007년 발레리 플레임의 CIA 요원 신분과 관련해 기자들과 나눈 대화와 관련해 플레임 사건을 수사하는 대배심원들에게 거짓말을 한 혐의로 사법방해 혐의로 기소됐다.[32][33]리비는 방해죄와 관련 범죄로 유죄를 선고받았지만 30개월의 징역형은 조지 W 부시에게 감형됐고, 핵심 증인이 증언을 취소한 뒤 2018년 도널드 트럼프에 의해 사면됐다.[34][35]
- 콘래드 블랙은 2007년[36] 7월 토론토에 있는 자신의 사무실에서 금융 기록이 담긴 상자 13개를 법원 명령에 의해 봉인된 후 며칠 후에 상자를 돌려준 혐의로 사법방해죄로 유죄판결을 받았다.블랙은 2019년 5월 도널드 트럼프에 의해 사면됐다.[37]
- 배리 본즈는 2011년 BALCO 스테로이드 스캔들을 수사하는 대배심원들에게 자신의 개인 트레이너가 스테로이드를 주었는지에 대해 거짓말을 한 혐의로 사법방해 혐의로 기소되었다.[38]본즈는 유죄판결을 받고 30일 가택연금형을 선고받았으나 이후 항소심에서 유죄판결이 뒤집혔다.[39]
- 도널드 트럼프 대통령에 대한 탄핵 노력이 2016년 대선 러시아 간섭 수사, 트럼프-우크라이나 스캔들 수사를 방해해 정의를 방해했다는 주장이 제기됐다.뮬러 보고서는 트럼프 대통령의 제임스 코미 FBI 국장 해임, 증인들에 대한 영향력 행사, 로버트 뮬러 특별검사에 대한 법무부의 감독에 영향을 미치려는 시도, 뮬러 특검을 해임하려는 시도 등 10건의 잠재적 방해 사례를 기술했다.[40]하원 법사위원회는 그 의혹에 대한 조사를 시작했다.[41][42]
- 1월 6일 미국 수도에 대한 공격에 참여한 참가자 중 상당수는 사법방해죄/의회죄로 기소되었다.[43][44]
