미국 헌법 수정 제17조 본문
미국 상원은 각 주에서 2명의 상원의원으로 구성되며, 각 주의 국민이 선출하며, 각 상원의원은 1표씩을 갖는다.각 주의 선거인은 주의회 중 가장 많은 지부의 선거인에 필요한 자격을 갖추어야 한다.
상원의 어느 한 주를 대표하여 결원이 생겼을 경우, 해당 주의 행정당국은 그 결원을 채우기 위한 선거장을 발행한다.단, 주 입법부는 입법부가 지시하는 바에 따라 국민들이 선거로 결원을 채울 때까지 행정관에게 임시 임명을 할 수 있는 권한을 부여할 수 있다.
이 개정은 [1]헌법의 일부로서 유효하게 되기 전에 선출되는 상원의원의 선출이나 임기에 영향을 미치는 것으로 해석해서는 안 된다.
상원 결원을 관리하는 주지사 임명
특별 선거에 의한 결원 보충
다음 5개 주에서는 상원의 공석을 선거로만 채울 것을 요구하고 있으며,[2] 주 주지사가 임명까지 채울 수 없습니다.
도지사 임명 후 가까운 특별 선거로 결원 채우기
다음 9개 주에서는 주지사가 임명으로 상원 공석을 채울 수 있습니다.그러나 특별선거는 [2]공석 후 몇 달 안에 치러져야 한다.

다음 36개 주에서는 주지사가 임명으로 상원 공석을 채울 수 있습니다.임명된 상원의원은 임기 중 또는 다음 주 전체 [2]총선까지 재임할 수 있다.
상원 당선자의 임명
과거 총선 이후 퇴임하거나 낙선한 상원의원들은 여러 가지 이유로 임기가 만료되기 전에 사퇴하는 경우가 많았다.
그 흔한 이유 중 하나는 주지사들이 공석인 자리에 후임자를 임명하도록 허용하기 위해서였다.이것은 그들의 후임자들이 선택 위원회 배정을 얻기 위해 다른 신입생 상원의원들보다 더 많은 연공서열을 얻을 수 있게 해주었다.이 관행은 1980년 양당이 조기 입성한 상원의원에게 더 이상 연공서열을 부여하지 않는 신당규를 제정하면서 막을 내렸다.사무실과 주차 공간을 [3][4]선택할 때 연공서열이 여전히 중요했습니다.
1966년, 1974년, 1978년 선거에서는 연금법이 개정되면서 상원의원들은 1월 초 임기가 만료될 때까지 기다리지 않고 12월 31일 이전에 사임하는 것이 유리해졌고, 이는 [5]임명된 상원의원의 수를 증가시키는 데 기여했다.
또 후임자 선출 후 3명의 상원의원이 사망해 후임자가 조기 [6]임명돼 취임할 수 있게 됐다.

1913년 수정헌법 제17조 비준 이후 상원의원에 임명된 상원의원은 모두 241명으로, 다음 예정선거나 특별선거 이전에 임명된 199명과 이미 선출된 상원의원 당선자 42명을 포함했다.
