제32차 헌법 수정안(시나드 아이레안 폐지) 2013년[1] 법안은 아일랜드 의회인 오이레흐타스 상원시나드 아이레안을 폐지하기 위해 아일랜드 헌법을 개정하자는 제안이었다.[2] 이 제안은 2013년 10월 4일 국민투표에서 51.7%가 찬성 48.3%에 반대해 부결됐다.[3]

이 법안은 2013년 7월 23일 오이레흐타스 왕가의 통과를 완료했다. 만약 그것이 승인되었다면, 시나드는 다음 아일랜드 총선이 끝난 후, 다일 에이어란을 오이라크타스의 단독 주택으로 남겨두고 존재는 중단되었을 것이다.[2]

제303조 개정안이 이날 통과됐기 때문에 '제30조 수정안'은 없다.

배경

시나드는 다일보다 훨씬 약한 방이다.[4][5][6] 정부는 보통 다일이 통과시킨 법안을 1964년 이후 거부하지 않고 있는 시네드에서 과반수를 차지하고 있다.[4] 샤나드의 장래에 대한 논쟁은 (개헌이 있든 없든) 그것을 개혁하는 것이 좋을지 아니면 아예 폐지하는 것이 좋을지에 초점이 맞춰져 있다.[4] Fine Gael의 리더 Enda Kenny는 2009년 10월에 Fine Gael 정부가 Seanad를 폐지하는 것이 의 의도였다고 말했으며, TD의 수를 20명 줄이는 것과 함께, Dail의 임기 동안 약 150만 유로를 절약할 것이다.[7] 이는 그가 2009년 7월 시네드 폐지보다는 개혁을 주장했던 연설과 대비된다. 2013년 8월 친 시아나드 옹호자는 케니의 변화가 당 고문들의 '비밀 보고서'에 의해 촉발됐다고 주장했고 파인 가엘은 문제의 문서가 2010년 3월 발간됐다고 답변했다.[8]

2011년 선거 운동에서도 노동당신페인당은 시나드 폐지를 약속했고,[9][10] 피아나 파일은 이 문제에 대한 국민투표를 지지했다.[11] 선거에서 집권한 파인 가엘-라부르 연합의 프로그램은 보다 광범위한 헌법 개혁 프로그램의 일환으로 시네드를 폐지할 것을 약속했다.[12]

파인 가엘의 2011년 선거 선언문은 취임 후 12개월 이내에 시나드를 폐지하는 국민투표를 실시하겠다고 공약했는데, 2012년 도이세아흐로서 엔다 케니는 법안 도입이 지연된 것은 필요한 변경사항의 복잡성 때문이라고 설명했다.[13] 상정된 법안은 헌법 전문을 40개 수정한다.[2] 시나드에 대한 참조를 삭제하는 것은 물론, 개정안은 그것을 명시적으로 폐지하기 위해 과도기적인 조항을 삽입해야 했다. 이들은 개정안이 법으로 제정된 시점인 2013년 가을로 예상되는 시점과 2016년이 되어서야 폐지 효력이 발생할 수 있는 시점 사이에 연기할 수 있도록 했다.

법안은 2013년 5월 초 내각에서 논의되었고,[14] 6월 5일 내각의 승인을 받았으나, 조안 버튼 장관은 이 법안을 자세히 검토하지 않았다고 말했다.[15] 그 법안은 그날 저녁 케니와 타나이스테 에몬 길모어가 모두 발언한 기자회견에서 발표되었다.[2][16] 정부는 또 시나드 폐지로 필요한 법안들에 추가로 오이라크타스 위원회와 법안 논의에 대한 상임 명령의 변경도 약속했다.[17]

2013년 6월 13일 다일 강에서 두 번째 독서가 시작되었고,[18] 6월 25일 그곳의 모든 단계를 통과했다.[19] 그러자 다일은 투표용지 문제의 자구에 대한 결의안을 통과시켰다.[20] 이 법안은 다음날 시네드에서 도입되어 7월 23일 최종안을 통과시켰는데,[21] 찬성 33표 대 반대 25표로 통과시켰다.[22] 도이세아치가 지명한 상원의원 2명이 이 법안에 반대표를 던졌고, 지난주 정부의 2013년 '임신생명 보호 법안'에 반대해 채찍을 잃은 파인겔 상원의원 2명이 정부에 반대표를 던졌다.[22]

제안된 변경사항

만약 이 법안이 법으로 제정되었다면, 그것은 즉시 새로운 과도기적인 19A조항을 헌법에 삽입했을 것이다. 제19A조는 다음 총선 후 새로운 다일이 처음 앉기 전날에 헌법에 대한 다양한 변화가 촉발되었을 것이라고 규정했다. 이것들은 그 법안의 세 가지 별도 일정에 열거되어 있다.[23]

이 두 과도기적 조항은 폐지일 이후 공식 헌법판에서는 인쇄되지 않았을 것이다;[23] 이것은 현재의 아일랜드 국가가 아일랜드 자유국계승한 1937년의 과도기적 조항들의 처리를 모방한다.

결과적 변화

시나드나 두 집 사이의 관계를 기술하는 조항과 섹션은 삭제되었을 것이다; 삭제된 섹션의 공백을 메우기 위해 기사의 후반 섹션은 번호를 다시 매겼을 것이지만, 이후 조항은 번호를 다시 매기지 않았을 것이다.[23] 제53조와 제55조는 아일랜드 자유주의 오이라크타스에서 임시조항을 사용하며, 1937년 이후 시네드와 관련되었기 때문에 삭제되었다.

그 밖의 많은 결과적인 변화에는 "오리아흐타스 가문[s]을 "다일 아이레안"으로 대체하는 것이 포함되었다. 일부 변화는 덜 기계적이었다.[23]

  • 대통령 선거 후보를 지명하려면 20명의 오이라크타스 멤버가 아닌 14명이 필요했을 것이다. 이는 오이라크타스 회원 수를 226명(상원 60명+TD 166명)에서 158명(모든 TD, 별도 으로[24] 감축 예정)으로 줄인 것을 반영했다.
  • 대통령 탄핵은 각 집의 3분의 2가 아니라 다일의 5분의 4 절대다수를 요구했을 것이다.
  • 고등법원 판사나 대법관을 해임하거나, 감사관이나 감사관은 양원의 단순 과반수 대신 다일의 절대다수를 요구했을 것이다. 헌법은 하급법원을 언급하지 않지만, 법관의 임기는 법령상 동일하기 때문에 마찬가지로 바뀌었을 것이다.[25]
  • 다일의 레스-첸 콤하렐레대통령 직속 위원회국무회의의 시나드의 카타르오일레흐를 대신했을 것이다. Ceann Comhairle 또는 Leas-Cheann Comhairle을 사용할 수 없는 경우, 추가로 두 명의 TD가 Ceann ComhairleLeas-Chean Comhairle의 대체 선수로 지명되었을 것이다.
  • 다일이 달리 결의하지 않았다면 법안이 돈 법안인지에 대한 세안 콤하렐의 의견은 결정적일 수밖에 없었을 것이다. 지폐가 남긴 유일한 의의는 26조에 따라 대통령이 대법원에 회부할 수 없었다는 점이었을 것이다. 현재 그 지정은 또한 그러한 법안에 반대하는 시나드의 권한을 제한하고 있다; 만약 시나드가 세안 콤하일의 지정에 동의하지 않는다면, 이 문제는 대통령이 판사가 위원장으로 하는 특권 위원회에 회부할 수도 있다.
  • 대통령에게 긴급하게 법안에 서명하라는 요구는 시네드가 아닌 다일의 동의를 요구했을 것이다.
  • 일반적인 국민투표는 폐지되었을 것이다. 현재 그러한 국민투표는 오직 시네드에 의해 법안이 부결될 경우에만 소집될 수 있다.

토론에서의 입장

탈권위

이 법안에 찬성하는 주장들에는 폐지가 돈을 절약할 수 있다는 것, 입법자의 수가 주 인구와 비교해서 너무 많다는 것, 선출 방법이 엘리트주의적이고 비민주적이라는 것, 그리고 시나드가 힘없는 고무줄이라는 것이 포함되어 있었다.[26] 국민투표 일주일 전 아일랜드타임즈 여론조사에서는 '예스보터'가 제시한 이유로는 비용(43%), 권력 부족(16%), 초호화(14%), 정치인 감소(8%), 민주선거 부재(5%)[27] 등이 꼽혔다.

폐지는 파인 가엘,[28] 노동당,[28] 신페인,[29] 사회당이 지지했다.[30] 신페인당은 오이라흐타스에서 이 법안에 반대하며 샤나드의 장래는 헌법협약에서 논의해야 한다고 주장했지만 7월 말 샤나드가 '엘리트하고 연락이 두절된 상태'[29]인 만큼 폐지를 지지한다고 발표했다.[17][31]

2013년 9월 2일, "원 하우스"라고 불리는 비당파 친탈당 단체가 캠페인을 시작했다.[32][33] 반대론자들은 키에런 멀베이의 참여가 노동위원회 위원장으로서의 직업적 지위를 손상시켰다고 주장했다.[34]

데스몬드 오말리 진보민주당 창시자는 시나드 폐지와 추가 정치 개혁을 요구했다.[35]

파인 가엘 캠페인은 시나드 폐지 납세자에 대한 연간 순저축액이 20m 유로가 될 것이라고 주장했는데, 이는 반대론자들이 이를 반박하는 수치다.[36] 국민투표 위원회는 오리아흐타스 재무관에게 서신을 보냈다. 오이라크타스 재무관은 샤나드의 연간 비용을 상원의원과 그들의 개인 직원들에 대한 급여와 비용으로 8.8m, 지지와 기반시설에서 9.3m, 연금으로 2m로 책정했다.[36][37][38] 이 장교는 시네드를 폐지함으로써 이 비용을 얼마나 절감할 수 있을지는 가늠할 수 없다고 말했다.[36][37][38]

탈권위 방지

이 법안에 반대하는 주장들에는, 노투표가 시네드의 개혁을 위한 위임장을 만들 것이다, 입법과정에 더 많은 정밀조사가 필요하다, 그리고 대부분의 웨스트민스터 시스템 국가들이 양원제 의회를 가지고 있다, 그리고 아일랜드 재정위기가 더 많은 통치권의 필요성을 보여준다는 등의 것들이 포함되어 있었다.[26] 국민투표 일주일 전 아일랜드타임즈 여론조사에서는 예비 비투표자들이 정부에 대한 견제로 제시한 이유(54%) 정부를 싫어한 이유(20%)와 상당한 비용 절감 효과가 있을 것으로 믿지 않았기(6%)[n 1][27] 등이 꼽혔다.

피아나 파일은 폐지에 반대하고 대신 시나드 개혁을 지지한다고 밝혔다.[17][31] 녹색당은 폐지가 '작은 정치권'에 집중된 권력이라고 반대했다.[39] 2013년 9월 25일 2013년 임신 생명 보호에 반대한다는 이유로 파인 가엘에서 제명된 오이라크타스 회원들의 개혁 동맹이 노투표를 요구했다.[40] 아일랜드 노동당은 이 법안을 "내각 내부의 부엌 찬장 장악"[41]이라고 규정했다.

시네드의 독립된 회원들은 그것의 폐지에 반대했다. 2012년 마이클 맥도웰, 조 오툴, 노엘 윌런, 피어걸 퀸, 캐서린 자포네는 시네드에서 논의된 '열려, 닫지 마'라는 슬로건을 내걸고 30쪽 분량의 시네드 개혁 청사진을 발표했다.[42][43] 이들은 2013년 5월 '민주주의 문제'가 된 '세아나드 개혁단'을 결성해 폐지에 반대하는 로비를 벌였다.[44] 2013년 상하원 2개 그룹과 TD 1개 그룹이 각각 선거권이 제한된 직업별 패널 선거를 총선거로 대체해 샤나드 개혁을 제안하는 별도의 법안을 도입했다.[45][46][47] 북아일랜드 출신의 전 도이세아치 지명 상원의원 몇 명은 시나드가 주 정치에 대한 국경을 넘나드는 의견을 제시할 기회를 지지했다.[48]

에밋 스태그 수석을 포함한 여당인 노동당의 몇몇 TD들은 오이라크타스에서 이 법안을 지지하면서 국민투표에서 폐지에 반대표를 던지겠다고 말했다.[49] 아일랜드 학생 연합은 투표 금지 운동을 벌였다.[50]

빈센트 브라운 등 논평가들은 엔다 케니가 2009년 시나드 폐지 의사를 밝힌 것은 몇 달 전 입장에서 유턴한 것이며, 어떤 당 동료와도 상의하지 않고 발표한 충동적인 홍보 수법이라고 제안했다.[51][52]

브레다 오브라이언은 유권자들이 투표용지에 "No" 상자를 체크하고 "Reform"이라는 단어를 써야 한다고 제안했는데,[53] 이는 투표를 망칠 위험에도 불구하고 핀탄 오툴이 지지한 제안이다.[54] 두 칼럼니스트들은 정부가 다일 절차에 대한 개혁을 입법부에서 내각과 경제관리위원회로의 권력 이양을 위장하기 위한 가식이라고 묘사했다.[53][54]

국민투표운동의 과정

주민투표위원회는 2012년 6월 6일 환경·공동체·지방자치부 장관이 설치했으며 고등법원 판사 엘리자베스 던이 위원장을 맡았다.[55][56] 이러한 위원회는 법률에 의해 국민투표를 감독하도록 요구되었지만, 이전의 위원회는 관련 개정 법안의 오이라크타스를 성공적으로 통과하기 전에는 설립되지 않았다.[56] 이 사건의 초기 설립자는 이전의 주민투표 운동이 유권자들이 고려된 의견을 형성하기에 너무 짧았다는 불평에 대응한 것이었다.[56]

도이서치의 소규모 공무원들이 이 법안을 통과시키기 위한 정부의 캠페인을 도왔다. 이 법안이 국민투표에서 다수결로 통과될 경우, 이 팀은 시네드에 대한 모든 언급을 삭제하기 위해 그에 따른 법령 변경 계획을 수립할 수 있었을 것이다. 이러한 변화들은 다음 총선에 이어 새로운 다일이 만나기 전에 시행되어야 할 필요가 있었을 것이다.[57]

2013년 7월 23일 이 법안이 시나드에 의해 통과된 후, 파인 가엘의 트윗에는 국민투표 날짜는 10월 4일이 될 것이라고 적혀 있었다.[17] 발표 방식에 대한 비판이 있었고, 정부는 그날 저녁 늦게 날짜에 대한 공식적인 결정이 내려졌다고 부인했다.[17] 다음날 필 호건 지방정부 장관은 10월 4일을 시나드 법안에 대한 국민투표 날짜로 정하고, 상고법원 설치를 위한 또 다른 헌법개정안에 대한 별도의 국민투표를 실시하도록 필요한 명령을 내렸다.[58]

파인 가엘 '예스' 투표 캠페인은 리처드 브루턴 장관이 주도하고, 초선 TD 레지나 도허티가 지원했으며, 그는 시나드를 캠페인을 시작하는 기자회견에서 "놀랄 정도로 비민주적"이라고 묘사했다.[59] 데이비드 노리스는 시나드에서 "오리아흐타스에서 젖은 주말이 아니었고 그녀의 환상을 통해 이야기를 나누고 있는 누군가로부터 레지나 독백을 들어야 한다는 생각에 가능한 가장 강력한 방법으로 반대한다"[59]고 말했다. 그는 나중에 이 발언을 "내성적"[60]이라며 철회했다.

국민투표위원회의 전용 웹사이트는 2013년 9월 5일에 개설되었다.[61][62]

시나드는 2013년 8월 20일 피아나 파일의 마크 댈리 상원의원의 청원이 필요한 상원의원 20명의 지지를 확보한 후 여름 휴회 기간부터 일찍 회수되었다.[63] 이번 리콜은 장기 기증에 관한 2010년 EU 지침을 이행하는 2012년 법 제정 기구 해제 문제를 논의하기 위한 것이었다.[63][64] 거의 사용되지 않는 무효화 권력은 양원의 결의안을 필요로 한다.[63][65][66] 달일을 상기시켜 달라는 청원은 성공하지 못했고, 파인 가엘은 달리를 시나드 폐지 캠페인과 관련된 비싸고 효과적이지 못한 홍보 행위로 비난했다.[63]

일부 정부 위원들은 국민투표에서 폐지 수정안이 부결되면 정부가 대신 시나드 개혁안을 검토하겠다고 제안했다.[67] 다른 이들은 개혁이 투표용지에 기재된 선택사항이 아니라고 지적했다.[68][69] 9월 20일, 마이클 마틴 지도자의 질문에서 국민투표가 부결되면 도이세치가 시네드를 개혁할 것인지에 대해 묻자, 그의 대답은 "마틴 부교는 나를 그 길로 안내하지 않을 것이다"[70][71]였다. 9월 23일 리처드 브루턴은 국민투표가 부결될 경우 시네드를 개혁할 계획이 없다고 말했다.[72]

마틴은 9월 24일 다일절에서 국민투표 운동에서 공무원의 역할에 대해 의문을 제기하고, 케니를 폐지에 관한 공론화에 초대했다.[73] RTET는 국민투표를 사흘 앞둔 2013년 10월 1일 프라임타임에 대한 토론을 벌이겠다고 제안했다.[74] 케니는 참가하지 않기로 결정했지만, 리처드 브루턴은 참가하기로 동의했다.[75][76] 토론은 미리암 오칼라한에 의해 진행되었다.[77][78]

9월 29일 '선데이 인디펜던트'는 파인 가엘이 엔다 케니에 대한 언론 접근을 제한하고 있으며, 그들의 참석을 비판하기 위해 유명 무소속 상원의원 피어갈 퀸과 존 크라운을 선정했다고 보도했다.[79]

아일랜드 타임즈의 해리 맥기 씨는 샤나드 대학 선거구에서 투표권을 가진 중산층 졸업생들이 투표와 투표 모두에서 투표할 가능성이 높고 신페인 후보의 선거운동이 예스 쪽에 결정적일 수 있다고 제안했다.[80]

여론조사

일부 여론조사는 2013년 법안에 대한 국민투표에서 응답자들이 어떻게 투표할지를 구체적으로 물었고, 응답자들이 샤나드를 폐지해야 한다고 생각하는지에 대해 보다 일반적인 질문을 했다. 여기에는 2011년 샤나드 폐지안을 발표한 정부 프로그램 이후 실시된 여론조사가 포함되지만 2013년 이를 시행하는 법안이 발표되기 전이다.

결과

더블린 시의회는 투표 안내 카드를 생성하기 위해 구식 선거인 명부 파일을 사용한 후 사과했는데, 이로 인해 3만 5천 명의 유권자와 사망자가 투표 장소에 대한 잘못된 정보를 받게 되었다.[96] 올바른 데이터를 사용하여 카드를 재생성했다.[96]
