역사

기원 및 합병

1990년대 후반, 독일 태생인 Fabian Thylmann은 서로 다른 웹사이트에 걸쳐 포르노 마케팅에 사용되는 NATS(차세대 제휴사 추적 소프트웨어)를 만들었다.[23] 맨세프는 2004년 각종 '썸네일 갤러리 포스트'와 제휴 네트워크의 지주회사로 콩코디아대 졸업생 스테판 마노스, 오위삼 유세프(두 사람의 성을 가진 맨세프)의 자금 지원을 받았다. 이후 다양한 유료 사이트 중 브레이저스와 포르노 제작사를 설립했다.[1][24]

맨윈은 다른 인기 있는 음란물 단체들을 마구잡이로 인수했다.[30] 2010년 6월, 맨윈은 비공개 동영상 공유 사이트 Videobash.com(지금은 폐지됨)[1]을 개설했다. 2010년 9월, 맨윈은 다양한 틈새 포르노 사이트를 소유한 유로 리벤뷰를 인수했다.[31] 2010년 11월 맨윈은 연예인 뉴스 사이트 Celebs.com(지금은 폐지됨)을 소개했다.[1] 2010년 12월, 맨윈은 위드픽처스와 제휴하여 위드픽처스의 유료 사이트를 관리하였다.[32] 2010년 맨윈 매입은 1억3000만 달러의 부채를 차지했으며, 회사는 2011년 포트리스 투자 그룹, JP모건 체이스, 코넬 대학교 등 125명의 비밀 투자자들로부터 3억6200만 달러의 자금을 조달했다.[4][9][33][34]

맨윈은 2011년 5월 음란 동영상 공유 사이트 유폰을 인수했다.[35] 맨윈은 2011년 6월 트위스티스, 트위스티스 캐시 제휴 프로그램, 게이투브, 섹스투브, 트랜니투브 등 카셰드마케팅의 성인 관련 자산을 모두 사들였다.[36] 맨윈은 펑키 몽키 프로덕션과 파트너십을 맺고 3DXSTAR도 만들었다.[37] 2011년 11월, 맨윈은 플레이보이(Playboy)의 운영 파트너가 되어, 영국과 베넬룩스를 기반으로 다수의 텔레비전 채널과 온라인 서비스를 운영하는 플레이보이 플러스(Playboy Plus Entertainment)를 운영하고 있다.[38] 맨윈은 또 복수의 제휴 프로그램을 종합해 트래픽량이 많은 제휴 사이트 운영자를 대상으로 하는 서비스인 레전드 스테이츠도 출시했다.[39]

맨윈은 2012년 1월 미국 포르노 영화 스튜디오 디지털 플레이그라운드의 자산을 인수하는 계약을 체결했다.[40] 2012년 4월, 맨윈과 마이애미에 본사를 둔 RK 넷미디어 주식회사는 맨윈과 리얼리티 킹스가 공동으로 승인한 합병 통지서를 오스트리아 연방 경쟁 당국에 제출했다.[41] 맨윈은 2012년 9월 인수를 완료했다.[42] 회사 문서에 따르면, RK 홀딩스는 가을의 계약에 따라 더블린 회사인 Manwin Content RK에 수천 편의 포르노 영화를 사용할 수 있는 권리를 주었다.[43] 2012년 6월, 맨윈은 "코어" 네트워크를 위한 Babes.com을 출시했다.[44]

MindGeek로 리브랜딩

틸만은 2013년 10월 페라스 앤툰과 데이비드 타실로 등으로 구성된 이 회사의 고위 경영진에게 탈세 혐의를[48] 받고 맨윈 지분을 1억 달러에 매각했고,[49][50] 같은 달 말 회사명을 마인드겔로 변경했다.[51] 이것은 네트워크상에 있지 않은 매우 큰 포르노 튜브 사이트인 맨윈과 레드투브가 합병하면서 일어났다.[52]

기업구조

2013년 성인 산업 뉴스 사이트 XBIZ는 마인드지크를 "세계 최대 성인 엔터테인먼트 사업자"[50][63]라고 표현했고, 2013년 아일랜드 인디펜던트 신문과 통화한 맨윈의 대변인은 "세계 5대 대역폭 소비 기업 중 하나"라고 밝혔다.[14] 인터넷 음란물 리뷰 사이트 TheBestPorn.com에는 마인드지크가 소유하거나 대표한 음란물 회원 사이트 164개가 올라와 있다.[64]

'포른허브 네트워크'는 마인드윅의 포르노MD 검색엔진을 통해 접속 가능한 웹 2.0 웹사이트의 네트워크다.[65] 민지크는 [66]게이투브,[36] 페퍼츠,[67] 포르노IQ([68]포르노허브 출시), 포르노MD,[69] 포르노허브[66][57] 레드튜브[66][57] 썸질라, 튜브8,[57] 유펀 등 포르노허브 네트워크의 모든 웹사이트를 소유하고 운영한다.[66][57]

포르노허브 네트워크에서 가장 순위가 높은 사이트는 포르노허브, 레드튜브, 유폰이다. 2013년 11월 포르노허브에는 월 10억 명이 넘는 방문객이 있다고 보도됐고,[70] 2014년 12월 애드위크의 기사에는 포르노허브에는 매일 5000만 명이 방문한다고 적혀 있다.[71] Pornhub.com은 알렉사 글로벌 랭크 27위(2019년 3월 18일 기준)에서 득점하고 있다.[72] 포르노허브는 포르노허브가 자신의 동영상을 지적했을 때 느리거나 효과적이지 못한 행동을 하지 않았다고 일부 피해자들이 신고하는 등 비협의 포르노를 유치했다는 비판을 받아왔다.[73][74][75][76] 이들은 또 소녀시대를 상대로 한 성매매 알선 혐의가 제기된 뒤 소녀시대와 파트너십을 맺고 동영상을 홈페이지에서 삭제하지 않아 비난을 받았다.[77][78][75] 상당한 반발 끝에 2020년 12월 14일 포르노허브는 플랫폼에서 검증되지 않은 영상을 모두 삭제했다.[79]

정부 폐기물 위원회 반대

'만윈'은 연예계, 지역 경제단체, 지역사회 활동가, 성인오락 공연자, 헬스케어 옹호자 등이 연합해 지원받은 '정부폐기물 금지위원회'의 최대 웃돈이었다. 위원회는 캘리포니아 주 로스앤젤레스 카운티에서 촬영된 포르노 제작물에서 모든 질과 항문 성관계 장면에 콘돔을 사용하도록 하는 법안을 반대하는 No on Measure B 캠페인을 운영했다.[98][99] 노 온 메소드 B 캠페인은 로스앤젤레스 카운티 여성 연방, 로스앤젤레스 카운티 공화당과 자유당, 밸리 산업상업 협회(VICA), 로스앤젤레스의 로그 캐빈 공화당 등이 지원했다.[100]

광고

MindGeek은 매일 수십억의 광고 인상을 받는 TrafficJunky 광고 네트워크와 다른 사이트들을 이용하여 그들의 사이트에 광고를 주최한다.[101]

망상화

2013년 4월 세계에서 가장 인기 있는 일부 음란사이트(알렉사 랭크 기준)[104][105]의 방문객이 악성 제3자 광고로 악성코드가 기계에 설치되는 위험을 무릅쓴 것으로 알려졌다. 이러한 주장은 악성코드, 스팸, 사기 등에 관한 블로그를 쓰는 보안 연구원[106] 콘래드 롱모어가 했다.[107] 롱모어의 수치는 웹사이트에서 유해한 콘텐츠를 [108]찾는 구글 세이프 브라우징 진단을 이용해 수집됐으며, x햄스터와 포르노허브 등 2개 사이트에 대한 통계는 BBC뉴스가 발표했다.[104] BBC 기사는 롱모어의 연구를 바탕으로 x햄스터(민지크/맨윈 소유가 된 적이 없는) 면적의 5%와 포르노허브 면적의 12.7%가 변태성을 통합했다고 밝혔다.[104] 마인드지크(당시 여전히 맨윈으로 알려진)는 성명에서 롱모어의 데이터가 수집된 기간 동안 자신이 서비스한 광고 중 0.003%가 악성코드를 포함하고 있으며, 이들이 서비스하는 광고는 악성코드와 악성코드에 대해 모니터링을 받는다고 밝혔다.[104]

연령 제어 및 아동 보호

ASACP

2017년 디지털경제법이 관련 법안을 도입했고, 2018년 3월 마인드지크는 나이를 발표했다.2015년부터 독일에서 사용 중인 ID 연령 검증 도구는 2018년 4월 강제 연령 검증 도입에 맞춰 영국에서도 사용할 수 있게 된다. 이 소프트웨어는 영국 내에서 접근 가능한 모든 포르노 웹사이트에 상업적으로 이용 가능하게 하고, 독립된 영국 스튜디오, 제작자, 블로거들에게 무료로 제공되도록 의도되었다. 소프트웨어는 '제3자 연령 검증 기업'을 활용해 등록자의 나이를 인증하고, 그 후에는 다시 로그인하지 않고도 복수의 기기를 통해 복수의 사이트에 접속할 수 있다.[117] 민지크는 나이 검증 과정을 책임지는 기관으로 지정된 영국 영화 분류 위원회(British Board of Film Classification, British Board of Film Classification)에 나이 검증 솔루션을 제공하기 위해 경쟁하는 대표적인 민간 기업 중 하나이다. 시행일은 당초 2018년 4월이었지만 공론화 시간을 확보하기 위해 연기됐다.[118] 2018년 5월 영국의 디지털 권리 운동 단체인 오픈라이츠 그룹은 마인드기크의 데이터 보안 기록을 비판하며 "음란 사이트들이 연령 검증 도구를 소유 및 운영하도록 허용하면 사용자의 프라이버시 이익과 회사의 데이터 마이닝과 시장 이익 간의 이해 상충으로 이어진다"고 논평했다.2019년 10월 영국 정부는 기존의 계획을 포기하고 인터넷 규제 대체 시스템의 도입을 제안했다.[119][120]

독일의 연령 검증

독일에서는 2021년 7월부터 뒤셀도르프 법원에 청소년미디어보호위원회(Commission Commission for Youth Media Protection)가 민드기크의 자회사에 연령 검증 프로토콜을 의무적으로 도입하도록 요구하는 사례가 제기돼 왔다. 4개의 포르노 채널은 이 요청의 이행을 거부했는데, 일부 독일 뉴스 매체는 그들이 민드기크가 소유한 유폰, 포르노허브, 마이더티호비, 그리고 x햄스터라고 보도했다.[121]

소송

반독점

맨윈 라이선싱과 디지털 플레이그라운드는 2011년 11월 캘리포니아에서 .xxx TLD의 도입을 둘러싸고 ICM 레지스트리와 ICM 레지스트리를 상대로 독점금지 소송을 제기했다.[122] 이들의 주장 가운데 맨윈은 새로운 접미사를 도입하면서 ICANN과 ICM 레지스트리가 가격상한제 없이 도메인 등록을 비싸게 해 시장을 악용했고, 기업이 상표의 오타를 차단할 수 있는 조항이 없는 방어 도메인 등록의 필요성을 조성했다고 주장했다. Manwin은 당시 Manwin의 파트너였던 Fabian Thylmann과 함께 "우리는 XXX 도메인과 그 모든 것을 반대한다. .XXX 도메인은 인터넷에서 사업을 하는 모든 기업에 폐를 끼치는 반경쟁적 사업 관행이라는 게 내 생각이다."[123]

ICM은 2012년 9월 맨윈 라이선싱 인터내셔널을 상대로 1억2000만달러의 손해배상 청구소송을 냈다. 24페이지에 달하는 긴 주장 중 일부는 다음과 같다: "맨윈, 디지털 플레이그라운드, 그리고 그들의 관련 회사, 계열사, 브랜드, 그리고 특정 제3자 계열사들이 .XXX TLD를 보이콧하기 위해 음모를 꾸몄으며 제3자에 의한 .XXX 웹사이트 불매운동을 강요하거나 부추겼다."[124]

ICM의 반론도 모두 2013년 2월 하반기에 기각됐다. 이 사건의 판사는 "ICM에 대한 손해만으론 독점금지 상해를 입힐 수 없다"고 밝혔다. 경쟁과정에 위해를 가해야 한다고 주장했다.[125]

2013년 5월, 맨윈은 .xxx 웹 도메인 이름 비용을 둘러싸고 ICM 레지스트리를 상대로 제기한 독점금지 소송을 해결하기로 합의했다. 이번 합의로 2013년 5월 한 달간 xxx 명의 도매가격은 연간 7.85달러가 할인되며, 향후에도 비슷한 할인혜택이 제공될 예정이다.[126] ICM 레지스트리는 영국의 팩스 거물이었던 스튜어트 롤리가 소유하고 있다. 이 합의는 ICM이 민드기엑에게 직접 돈을 지불하지 않을 것을 규정하고 있다.

특허

2013년 5월, 엑시트익스체인지사는 자사의 팝 언더 광고 특허가 Tube8.com과 Pornhub.com에 의해 침해당했다며 텍사스에서 맨윈 USA를 고소했다.[127]

만윈은 2013년 7월 미니애폴리스에서 SKky Inc.의 운영사인 존 미켈슨과 로버트 프라이드슨으로부터 모바일 기기에 압축 오디오와 이미지를 전달하는 방법을 기술한 특허 침해 혐의로 고소당했다.[128]

2014년 10월, MindGeek USA Inc.[129]는 Delaware의 보존 기술 LLC로부터 데이터 배포 및 통신 시스템에 관한 11개의 특허 컴포넌트를 운영한 19개의 다른 사이트에 대한 침해 혐의로 소송을 당했다. 이 사건은 2015년 3월 마인드긱이 보존기술 LLC와 합의점을 찾은 후 철회되었다.[130]

비동의 포르노 호스팅

마인드지크는 2020년 12월 캘리포니아에서 걸스도폰이 제작한 비협의 포르노물을 유치한 혐의로 고소당했는데, 이 음란물이 거짓으로 여성들에게 동영상 출연을 강요했다. 원고 40명은 조난, 배척, 트라우마, 자살미수 등 8천만 달러의 손해배상을 청구했다. 이 소송은 마인드지크가 이 회사의 성매매 사실을 빠르면 2009년, 확실히 2016년 가을까지 알고 있었지만 회사가 소멸될 때까지 계속해서 걸스도포른과 파트너십을 맺었다고 주장하고 있다. 마인드지크는 콘텐츠 파트너이자 뷰셰어 프로그램의 일원으로 걸스도폴른을 출연시켰다. 이번 소송은 또 마인드지크가 피해자들의 철거 요청에도 불구하고, 최근인 2020년 12월에도 걸스도폰 동영상을 삭제하지 않았다고 주장하고 있다. 2021년 10월 미공개 조건으로 타결된 이 소송에 또 다른 여성 10명이 동참했다.[131][132][133][134][135]

2021년 1월 몬트리올에서도 비슷한 주장을 하는 집단소송이 시작됐다. 캐나다 정부가 제안한 집단소송은 2007년 이후 미성년자일 때 촬영된 포르노 사진 및 동영상 중 일부는 동의 없이 마인드지크의 사이트에서 공유된 것일 수 있는 6억 달러를 요구했다.[15] 이 소송은 마인드지크가 고의로 "성매매 증거가 증가하는 것에 대해 사업 파트너를 조사하거나 심문하지 않았다"[16]고 명시했다.

아동 성매매 피해 아동 성학대 자료 유치

2021년 2월 앨라배마에서 민드기크를 상대로 한 민사소송이 시작돼 아동 성매매 피해자를 대신해 민드기크·포르노룹에 대한 청구를 평준화했다.[17] 이 소송은 포르노허브에 의해 원고의 아동 성학대 자료가 업로드되고 이익을 얻는 방법에 관한 주장을 펼쳤다.[18] 국립성 착취법률센터 등 수많은 로펌들이 피해자들을 대신해 제기한 이번 소송의 혐의는 언론인 니콜라스 크리스토프가 2020년 12월 '포르노허브의 아이들'이라는 제목의 기사에서 뉴욕 타임즈에 폭로한 것과 성격이 유사했다.[136][137]
