Cairn Energy and Government of India dispute

케언 에너지와 인도 정부 분쟁은 주로 2005-2006년에 발생한 세금과 투자 분쟁이다.[1][2] 이 사건은 케언의 인도 파트너인 베단타(Vedanta)와 밀접하게 연관되어 있으며, 소급과세 형태의 Ex 사후법, 상호투자조약, 민간과 주권국간의 국제중재 등과 같은 개념들과도 관련이 있다.

개인 투자자 국가 중재 절차(Cairn Energy PLC & Cairn UK Holdings Limited v) 헤이그에 있는 상설 중재 재판소의 인도 공화국)은 2015년 9월 22일 유엔 국제무역법위원회(UNcITRAL) 규정에 따라 시작되었다. 케인이 청구한 보상금은 5억 5,8400만 달러였지만, 최종 중재상 1억 2,200만 달러의 상금은 케언에게 유리하게 2020년 12월 21일에 발표되었다.[3][4] 케언은 중재재판을 실시하기 위해 미국, 영국, 캐나다, 프랑스, 싱가포르, 모리셔스, 아랍에미리트, 케이맨 제도, 네덜란드 등 전 세계에 상을 등록했다.[1] 2021년 5월, 케언은 뉴욕에서 에어 인도를 고소했다.[5] 2021년 7월, 파리 재판소는 프랑스에 있는 인도 재산을 압류하라는 케른의 주장을 받아들인다.[6]

인도 소득세 항소심 재판소의 베단타 자원 대 인도 정부 사건,[7][8] 델리 고등법원 사건 등이 해당된다.[9]

인도는 2012년 소득세법을 개정해 옛 투자에 대한 세금을 징수할 수 있도록 하는 개정·개정안을 추가했다. 인도는 2015년 캐런에 이 법을 적용했지만 2014년에도 보다폰에 이 법을 적용했다. 이 사건은 상설 중재 재판소로 넘어가 2020년 9월 보다폰이 유리한 판결을 받았다.[10][11] 2021년 8월, 인도는 소급 세금 조항을 폐지했다.[12]
