제라드 윌리엄 어거스틴 호건(Gerard William Augustine Hogan[1], 1958년 8월 13일생)은 아일랜드의 판사, 변호사, 학자로서 2021년 10월부터 아일랜드 연방대법원 판사로 재직하고 있다. 앞서 2018~2021년 유럽법원장, 2014~2018년 상고법원 판사, 2010~2014년 고등법원 판사를 지냈다. 호건은 처음에 헌법과 행정법에 관한 법률 전문 변호사 겸 강사로 일했다.

초년기

호건은 티퍼리 카운티의 칼릭온수이르 출신이다. 그는 1958년 마이와 리암 호건 사이에서 태어났다.[2] 그의 아버지는 마을에 있는 크리스천 브라더스 중등학교의 부교장이었다.[3][4] 그는 1979년과 1981년에 BCL과 LLM 학위를 받은 더블린 대학에서 교육을 받았다.[5] 그는 1981년 폴 맥더모트, 레이먼드 번과 함께 그의 첫 번째 책 "죄수의 권리: 아일랜드 교도소법에 관한 연구"를 공동 저술했다. 그는 존 F학점을 받았다. 케네디 추모 장학금은 펜실베이니아 대학교 로스쿨에서 LLM을 위해 공부한다.[6] 그 후 그는 킹스 인스네스에 다녔다. 그는 UCD에서 LLD를 소지하고 있으며 2001년 트리니티 칼리지 더블린에서 법학 박사학위를 받았다.[7][8] 2021년 5월, 로열 아일랜드 아카데미의 회원이 되었다.[9]

사법경력

고등법원

2010년 고등법원 판사로 임명되었다. 그는 임명 직후 자택에서 아픈 아기의 수혈과 관련한 긴급 청문회를 열었다.[40] 그는 마리 플레밍이 2012년 사망할 수 있는 권리를 추구하며 취조한 사건을 들은 판사 3명 중 한 명이었다.[41] 그가 2014년 국제 세이프 하버 프라이버시 원칙에 대해 유럽 사법 재판소에 언급한 것은 그랜드 체임버스에 의해 세이프 하버 결정이 무효라는 선언으로 귀결되었다.[22]

상고법원

유럽 사법 재판소의 장군 옹호

2018년 5월 아일랜드 정부로부터 유럽사법재판소(European Justice of Justice)의 주창자로 지명되었다.[42] 그의 임기는 2018년 10월에 시작되어 2024년 10월에 만료되었을 것이다.[3] 앤서니 콜린스는 2021년 연방대법원 임명에 이어 임기를 마치도록 임명됐다.[43] 호건은 2021년 10월 7일 임기를 마쳤다.[44]

그는 첫 번째 의견 중 하나에서, 프랑스의 Conseil d'étattat의 참고자료에서, 규정 (EU) No 1169/2011 유럽 의회와 2011년 10월 25일 평의회의 1169/2011은 이스라엘이 점령한 영토에서 생산된 제품들이 그러한 영토에서 생산된 것인지 여부를 표시하도록 요구한다는 것을 발견했다.[45] 그의 의견은 사법 재판소가 뒤따랐다.[46]

대법원

2021년 4월 아일랜드 정부는 그를 아일랜드 대법원에 지명했다.[47] 그는 2021년 10월에 임명되었다.[48]
