Police Complaints Authority (India)

경찰민원청(PCA)은 부적절하거나 조잡한 수사, FIR 제소 거부, 보호자 고문[1], 경찰에 대한 고압적인 수사 등의 혐의를 심판하는 기관이다.[2][3] 그러나 그 권고안은 잘못된 경찰 인력에 대한 조치를 주 정부에 구속력이 없다.[4][5] 17개 주는 주경찰법을 통해 PCA를 설립했고, 10개 주는 행정명령을 통해 PCA의 장기적인 목표를 가지고 이를 행하여 치안문화를 바꾸고 철저하게 전문화시키고 있다.[6]

역사

Prakash Singh and Ors. v. Union of India and Ors에 2006년 인도 대법원의 판결에 따라 주 및 지역 단위로 경찰 민원 기관을 설립할 예정이었다. Air 2006 SCC 1 사건,[7] 경찰에 대한 엄청난 불만과 고질적인 책임감 결여에 대응.[8][9]

케랄라입법회의는 2018년 12월 KPA 위원장이나 위원들이 정족수 없이 통과시킨 명령이 무효라는 2017년 HC 판정을 극복하기 위해 PCA 위원장이나 국가·지방자치단체 회원 1명 이상이 청원서를 처리할 수 있도록 한 케랄라경찰(개정)법 2018을 통과시켰다.[24] 케랄라 경찰청장은 법무법인 V K 모하난으로 민원에 대한 수사를 할 수사기관이 없다.[25] 최고수사책임자(CIO) 자리는 2016년 관리폭력 수사로 제재됐지만 별다른 진전이 없다. 케랄라 주 경찰고충청(SPCA)의 최고수사책임자(CIO) 채용을 위한 정부고시 3건이 발표되고 있음에도 불구하고 CIO는 지금까지 채용되지 않고 있어, 채용을 실시하는 데 있어 관료주의적 리그마롤과 주 내무부의 명확성 부족을 지적하고 있다. 훨씬 전인 2016년에. 공개된 세 가지 통지 중 1, 2차 통지가 성행할 때 2차, 3차 통지가 발표돼 내무부의 혼란을 지적하고 있다.[26]

펀자브 경찰 민원처

2019년 10월, 정부는 '펀자브 경찰법, 2007'에 따라 경찰청 및 부서별 경찰청에 대한 임명을 허가하고, 펀자브 경찰(위원장 및 민원인위원 임명) 규칙, 2019년을 승인했다.[29] 2020년 1월 NS Kalsi(퇴직한 판사[31] 대신)가[30] 8명의 지원자로부터 3년간[32][33] 경찰고충청(PCA) 회장에 임명되었다.[34] 펀자브주 인권위 기록에 따르면 1997년부터 2018년 8월까지 접수된 총 2.63 라흐의 인권침해 민원 중 54%(1.44 라흐)가 직권남용, 어떤 경우에도 허위 암시, 불법 구금 등의 민원이 포함된 경찰 공무원에 대한 것이었다.[35]

타밀나두 경찰고발청

2020년 2월 텔랑가나 고등법원 판사는 주 정부에 SSC와 PCA의 헌법에 관련된 규칙과 규정을 3월 6일까지 제정하라고 지시했다.[38][39]

비판

경찰 민원 당국은 현재 당국의 희석된 규정에 물리지[41] 않는 레임덕 기관으로[40] 간주되고 있다.[42] 그것은 종종 정의의 지연으로 비판된다.[43]
