2015년 7월부터 인도 파티다르 지역 주민들은 OBC(Other Background Class) 지위를 노리고 [A]인도 구자라트 주 전역에서 공개 시위를 벌였다.

가장 큰 규모의 시위는 2015년 8월 25일 아메다바드에서 열렸으며, 수천 명이 참석했다. 이후 주 전역에서 폭력과 방화 사건이 발생하여 몇몇 도시와 마을에서 통행금지령이 내려졌다. 사기(수백만 루피) 가치가 있는 재산과 차량이 파손되고 파괴되었다. 그 주는 8월 28일까지 정상으로 돌아왔다. 정부와의 대화에도 불구하고, 이 운동은 9월 19일에 재개되었고 다시 폭력적으로 변했다. 정부는 2015년 9월 24일 일반부 학생들에게 장학금과 보조금을 지급하고, 2016년 4월에는 경제적으로 낙후된 계층을 위한 10%의 공간 할당제를 발표했다. 10%의 예약은 2016년 8월 구자라트 고등법원에 의해 파기되었다. 그 동요는 2년 더 계속되었다. 2019년 1월 인도 의회는 사회 경제적 약자에 대해 최대 10%의 보호권을 부여하는 헌법을 개정했다. 그 개정안은 대법원에서 이의를 제기하고 있다.[when?]

배경

인도에서 OBC(Other Background Caste, OBC) 지위는 교육과 정부 직업에서 할당량을 제공하는 차별 철폐 조처를 발동한다. 구자라트의 경우 정부 및 교육 좌석의 27%가 OBC, 7.5%가 예정 카스트, 15%가 예정 부족에 배정돼 전체 좌석의 49.5%를 차지하고 있다.[9][10][B] 대법원은 인드라 사위니 사건에 대한 1992년 판결에서 50%의 유죄를 선고했다.[11]

1981년 인도국민회의(INC)의 마드하브신흐 솔랑키 의장이 이끄는 구자라트 정부는 박시위원회의 권고를 바탕으로 사회경제적으로 후진적인 카스트(SEBC)에 대한 예약을 도입했다. 그 결과 주 전역에 걸쳐 반 보존 운동이 일어났고, 폭동으로 인해 100명 이상의 사망자가 발생했다. 솔랑키는 1985년 사임했으나 이후 182석 중 149석을 차지하며 권좌에 복귀했다. Kshatriya, Harijan, Adivasi, 이슬람교도의 지지를 받았으며, 총칭 KHAM이다. 이것은 패티다르스를 포함한 다른 지역사회가 정치적 영향력을 상실하게 했고 후에 INC를 소외시켰다. 파티다르는 구자라트 인구의 12.3%를 차지한다.[12][13] SEBC는 처음에 81개의 커뮤니티를 구성했고 2014년에는 146개의 커뮤니티로 확대되었다.[11][14][15] 1980년대에는 예약석 비율이 10%로 2014년에는 27%[16]로 증가했다.

파티다르 공동체는 공동체 내에서 계급 차별화에 직면해 있다. 경제적 기회가 위축된 파티다르 청년들과 하향식 사회적 이동성 때문에 기성세대 사이에서 불만이 커졌다.[12][17][18]

2015년 동요

7월

2015년 7월 파텔이라는 이름을 가진 파티다르 청년들은 OBC 지위를 요구하며 구자라트 전역에서 시위를 벌였고, 이는 파티다르에게 정부 일자리와 교육 분야의 지정 쿼터를 부여하게 된다.[22]

이들은 사회봉사단체인 사르다르 파텔 세바달의 지원을 받았으며, 를 위해 하딕 파텔이 이끄는 파티다르 아나마트 안돌란 사미티(PAAS)를 결성했다. 그 조직은 스스로를 비정치적이라고 묘사했다.[23] 파티다르 4개 주요 조직은 이 운동에 전혀 관여하지 않았다고 부인했지만,[24] 후에 호달담 신탁은 청소년들과 정부 사이에서 중재할 것을 제안했다.[25][26]

2015년 7월 6일 메흐사나에서 시작된 만세시위는 7월 22일 만사에서 열렸다.[27][28]

7월 23일 비스나가르에서 있었던 시위는 일부 시위자들이 일부 차량을 불태우고 바라티야 자나타당 MLA 리시케시 파텔의 사무실을 파괴하면서 폭력적으로 변했다.[29][30] 7월 28일 비자푸르메흐사나에서 시위가 열렸다.[29][31][32] 경찰은 시위를 벌여 금지명령 위반 혐의로 152명을 입건했다.[19] 7월 30일 루나바다에서는 시위가 있었다.[33]

8월

소셜 미디어는 이 시위가 주 전역에 빠르게 확산되도록 도왔다.[34][35] Demonstrations were held in Devbhoomi Dwarka district on 1 August;[36] in Gandhinagar, Navsari, Jam Jodhpur in Jamnagar district, Himmatnagar and Bagasara in Amreli district on 3 August;[37][38][39] in Rajkot on 5 August;[40] in Amreli on 10 August;[41][42] in Junagadh on 12 August;[43] and in Petlad on 17 August.[44] 8월 17일 수라트에서 열린 시위에는 10만[30] 명에서 45만 명으로 추산되는 인파가 몰렸다. 도시의 다이아몬드 및 섬유 시장은 몇몇 학교와 대학처럼 폐쇄적인 상태를 유지했다.[45][46] 8월 21일 수렌드라나가르,[47] 바루치, 발찌화르, 바도다라에서 시위가 열렸다.[48][49] PAAS는 8월 25일까지 37개의 집회를 조직했다.[50] 55일 동안 149개의 집회가 주 전역의 여러 단체들에 의해 조직되었다.[7]

8월 25-31일

2015년 8월 25일 아메다바드에서 집회

크란티 집회(Revolution 랠리)[35]로 불리며 8월 25일 GMDC 운동장에서 아메다바드에서 열린 주요 시위에는 50만 명 이상이 참가했다.[51] 공동체 구성원들은 행렬을 지어 구 수집가에게 요구 각서를 제시했다.[52] 집회를 주도한 하딕 파텔은 다른 사람들과 단식투쟁을 벌이겠다고 선언하면서 장관이 직접 참석하여 각서를 받을 것을 요구했다.[53] 집회가 끝난 뒤 경내 체류 허가가 없어 체포됐다가 나중에 석방됐다. 현장에 있던 사람들은 경찰이 무력으로 해산했다.[54][55][56] 경찰이 무력을 사용한 배경에 대해 조사하라는 지시가 내려졌다.[57]지도자인 아난디벤 파텔과 라자니칸트 파텔은 군중들에 대한 경찰의 기소 명령이나 허가를 부인했다.[58]

아흐메다바드 등지에서 폭력사태와 충돌이 발생했다. AMTSBRTS의 경찰차와 지역 교통버스에 불이 났다. 적어도 15건의 충돌과 방화 사건이 보고되었다. 폭도들은 CTM 지역의 상점을 파괴했고 경찰은 폭도들을 해산시키기 위해 8개의 최루탄을 발사했다. 최소 10명이 다친 가틀로디야에서는 라바리와 파텔의 충돌이 있었다. 대규모 폭도들이 라닙 근처의 철도 선로를 훼손하려 했다. 많은 차량이 파손되었다. 경찰과 언론인들에 대한 공격이 보도되었다. 144조에 따라 그 도시에 통행금지가 부과되었다. 아메다바드 시영공사는 시내버스 33대를 태우는 등 12대의 크로아티아 피해를 입었다.[5][54][59][60][61] 적어도 7개의 구청과 시민센터가 파괴되었다.[62] 인도 군대의 5개 회사가 이 도시에 배치되어 상황을 통제했다.[63]

수라트에서는 폭도들이 버스와 현금자동입출금기 2대, 승합차, 소방서 등을 불태우고 일부 재산을 훼손하면서 8월 25일부터 27일까지 통행금지가 부과됐다.[64][65] 120명 이상의 사람들이 체포되거나 구금되었다.[65] 바도다라에서도 폭력이 보고되었다. 아메다바드 바도다라 고속도로는 몇 시간 동안 선동가들에 의해 막혔다.[66] 버스 6대가 파손되면서 GSRTC 바도다라 사업부에 의해 총 1554번의 버스 여행이 취소되었다.[67]

Rajkot에서는 BRTS 버스 정류장에 불이 붙고 돌을 던졌다. 공공 및 사유 재산의 손상은 1.47 크로아로 추산되었다. 폭도들은 농무부 장관과 지역 하원의원 모한 쿤다리야의 사무실 두 곳을 샅샅이 뒤졌다; 경찰은 10발을 공중에 쏘고 57발의 최루탄을 투하하여 폭도들을 해산시켰다. 12명의 경찰관이 부상을 당했다. 경찰은 사건 관련 FIR 18명을 입건했다. 통행금지는 8월 26일에 48시간 동안 부과되었다.[2][4][68]

마흐사나, 비스나가르, 운자하메흐사나 지구 일부에서도 폭도들이 라즈니 파텔 장관, 니틴 파텔 내무장관, BJP MLA 제이쉬리 파텔의 집을 돌로 쳐서 불태운 뒤 통행금지가 부과됐다. 지구대는 각종 폭력·폭동 사건에서 FIR 25건, 13건을 수용했으며, 36명의 신원이 확인됐다. 이 사건에서 적어도 22명이 체포되었다. 그들 중 3명은 보석으로 풀려났다.[69] 이번 기물 파손은 모르비암렐리에서도 보고됐다. 파탄에서도 이틀 동안 통행금지가 내려졌다.[70][71][72]

3500명의 준군사력과 93개의 주 예비경찰이 배치되었다.[62] 이번 폭력사태로 사망한 사람은 아메다바드에서 5명, 수랏에서 경찰관이, 바나스칸타 지구에서 3명, 파탄 지구에서 1명 등 10명이었다.[2] 아메다바드의 바푸나가르에서 한 젊은이가 경찰 유치장에서 사망했다.[73] 주 전역에서 295명의 FIR이 접수되었고 650명이 체포되었다.[7] 주 전역의 학교와 대학들은 8월 26일부터 30일까지 문을 닫았다. 왓츠앱페이스북과 같은 휴대전화와 특정 광대역 신문의 인터넷 서비스는 8월 26~31일 동안 주 전역에서 차단되었다. 인터넷 블록은 아메다바드와 수랏에서 계속되었다.[74] 서부철도에 따르면 폭도들에 의해 8곳에서 선로가 파손돼 열차 51대가 결항됐다. 26대의 열차의 운행에 영향을 받았고, 15대의 열차는 주 밖으로 우회되었다.[2] 국가 소유의 교통 서비스인 GSRTC의 거의 140대의 버스가 주 전역의 폭도들에 의해 횃불에 휩싸였고 152대가 파손되었다.[62] 아흐메다바드에서 등록된 40건을 포함해 약 340건의 경찰 사례가 주 전역에 등록되었으며, 이 중 230건은 정부를 대표하여 등록되었다.[75] 경찰서는 200파운드의 피해를 입었다.[6]

8월 26일, 선동가들은 주 전체에서 하루 동안 휴업을 요구했다.[76] 그 주는 8월 28일까지 정상으로 돌아왔다.[63] 하딕 파텔은 인도의 다른 주들로까지 그 동요를 확대하려는 의도를 선언했다.[77] 는 여러 쟈트, 쿠르미, 구자르 지역사회 단체로부터 지원을 받자 총리에게 보낼 청원 운동을 선포했다.[78] 8월 31일 카람사드마디아 프라데시주 보팔에서 집회가 조직되었지만 큰 지지를 끌어내지 못했다.[79][80]

PAAS에 따르면 8월 25일 집회 후 사흘 동안 구자라트 전역의 파티다르 1482명을 상대로 총 457명의 FIR이 신청됐다.[81]

9월

인터넷 블록은 9월 1일 아메다바드와 수라트에서 해제되었다.[82] PAAS는 1930년 마하트마 간디의 역사적인 솔트 행진 단디에서 아메다바드로 가는 역행진을 조직할 것이라고 발표했다.[83][84] 단디 인근 33개 마을 촌장들이 행진을 반대했다.[85] 나바사리 지구수집가는 행진의 허가를 거부했다.[86] 이 행진은 9월[87] 13일로 일정이 변경되었지만 정부는 허가를 거부했고 PAAS는 행진을 취소했다.[88]

9월 9일 파텔은 파텔 나브니르만 세나(PNS)라는 새로운 기구를 발표하여 이 운동의 전국적인 확대를 도모했다.[90] 파텔은 9월 14일 정부 각료들과의 회의에[91] 앞서 케슈바이 파텔 전 장관을 만났다. 하딕 파텔과 랄지 파텔이 이끄는 파티다르 대표 20명은 장관이 주재하고 각료들이 참석한 회의였다. 논의된 사안으로는 8월 25일 경찰의 조치, 일반 학생에 대한 장학금 제도, 폭력 사망자에 대한 보상, 체포된 사람에 대한 석방 등이 포함됐다.[92][93] 파티다르스는 상징적인 보이콧으로 사바칸타 구 사바칸타 구 중앙협동은행의 케롤과 바드라드 지점들에서 거액의 현금을 인출했다.[94][95]

하딕 파텔은 바이하르의회 선거를 한 달 앞둔 2015년 10월 마디아 프라데시비하르에서 집회를 개최할 것이라고 발표했다.[96][97]

경찰은 9월 19일 에크타 야트라(유니티 행진) 집회를 당국의 사전 허가를 받지 않고 진행하려 한 혐의로 수랏 바라차 지역에서 하딕 파텔과 그의 지지자 35명을 구속했다. 이들은 IPC 188조에 따라 경찰 통보에 불복해 입건됐으며 FIR 2명이 이들을 상대로 소송을 제기했다. 그들은 나중에 보석으로 풀려났다.[98][99] 아메다바드, 수랏, 라즈코트, 바도다라, 모비, 나바드, 보타드, 비스나가르, 메흐사나, 잠나가르 등 여러 도시와 마을에서 시위, 방화, 재산 피해, 도로 봉쇄 등의 사건이 발생했다.[100] 파티다르 폭도들은 아메다바드의 라바리 식민지에서 라바리 공동체와 충돌했다. 수랏과 모비에서는 GSRTC 버스 2대가 파손됐다. 몇몇 장소에서 경찰은 군중들을 해산시키기 위해 최루탄과 통조림을 사용했다. 아메다바드, 간디나가르, 수라트, 바도다라, 라지코트 등 여러 주에서 휴대전화, 소셜미디어,[101] SMS 서비스 등의 인터넷이 24시간 다시 차단됐다. BSFRAF는 각각 12개의 회사가 배치되어 폭력을 통제했다.[102]

9월 19일, 메흐사나에서 경찰은 35명의 시위자들을 체포하고 그들을 고발했다.[103] 9월 22일 아라발리 지역 바야드 탈루카의 텐푸르 마을에서 경찰의 허가 없이 회의를 열었을 때 최소한 20명의 파티다르 지도자들이 체포되었고 FIR이 그들을 상대로 소송을 제기했다.[104][105] 하딕 파텔은 회의장에서 잠시 모습을 감추고 다음날 모습을 드러냈다.[106] 고등법원은 이 실종 사건을 '공공의 묘기'로 규정하고 법정 모독에 대해 경고했다.[105] 9월 23일, PAAS의 리더인 Nilesh Advadiya는 시위 혐의로 입건되었다.[106]

9월 24일, 구자라트 총장은 고등교육의 일반 학생에게 장학금과 보조금을 지급하는 계획인 묵하만트리 유바 스와블람반 요즈나(장관 청년자립계획)와 학교 교육에서의 교복과 무료 도서를 발표했다. 고등교육에서 이 제도는 이사 시험에서 90분위 이상의 학생과 학부모의 연소득이 4.5 lakh 이하인 학생들에게 제공된다. 그녀는 또한 정부 일자리에서 5년의 연령의 휴식을 제공했다.[107] 정부는 또 의공계 교육, 학생 호스텔 등 인프라에 대한 섭취를 늘리겠다는 뜻을 밝혔다. 그 계획에는 매년 1,000원의 재정이 소요될 것으로 예상된다.[108] 미국 파티다르 커뮤니티는 당초 나렌드라 모디 인도 총리의 방문 기간 중 뉴욕에서 대규모 시위를 벌일 계획이었으나 유엔 본부와 캘리포니아에서 시위를 벌인 일부 인사들을 제외하고 나중에 이를 취소했다.[109][110][111][112][113][114] 하딕 파텔은 이 계획을 '롤리팝'이라고 부르며 이들의 요구를 들어주지 않는다고 밝히고, 주 전역의 지역사회 구성원들에게 롤리팝을 나눠주는 '롤리팝 운동'을 전개했다.[115]

9월 26일, 라즈코트의 활동가 우메쉬 파텔은 이 운동을 지지하기 위해 자살했다. 주 정부는 이 사건에 대한 조사를 명령했다.[3][116] 구자라트와 해외에서 온 파티다르 의사 단체인 사르다 파텔 세바 자선 신탁은 이 소동으로 사망한 각 사람들의 친척들에게 Rs 1 크로어의 재정적 도움을 발표했다.[117] 공동체의 주요 조직인 우미야 마타 산스탄은 9월 28일 이 운동에 대한 지지를 발표했다.[118] 9월 4일 시위 단식을 한 혐의로 히맛나가르에서 체포된 9명의 시위자들은 이후 보석으로 풀려났다.[119]

10월

10월 1일 인도국민회의당은 이 운동에 대한 지지를 발표했다.[120] 하딕 파텔은 마하 키산 판차야트에서 농민들과 농민들에게 연설했다.[121] 폭동과 관련된 사건에서 더 많은 사람들이 체포되었고, 8월 25일 한 청소년의 보호자 사망 사건에서 두 명의 경찰관이 정직당했다.[122] 일부 파티다르 커뮤니티 회원들은 지난 10월 나브라티 축제 동안 가르바 행사장에 정치인들이 참석한 것에 항의했다.[123] 정치인들이 참석하는 행사에서도 항의했다.[124][125] 패티다르 주 전역의 많은 곳에서 여성들은 항의의 표시로 탈리스(철판)에 대해 벨런(롤링 핀)을 찧었다.[126]

하딕 파텔은 2015년 10월 18일 라즈코트에서 열린 인도와 남아프리카공화국 간의 제3회 원데이 국제 크리켓 경기에서 사우라슈트라 크리켓 협회 경기장에서 시위를 벌이고 크리켓 선수들의 길을 막겠다고 위협했다. 시내에는 8000여 명의 경찰 인력이 배치됐고 경기장에는 2500여 명의 경찰과 500여 명의 사설 경호 인력이 배치됐다.[127] 인터넷 서비스는 10월 17일 밤부터 10월 19일 아침까지 차단되었다.[128] 하딕 파텔은 이날 다른 6명과 함께 체포됐다.[129][130] 수라트와 바르돌리에서는 하딕의 구류에 반대하는 시위가 있었고, 모르비에서는 GSRTC 버스에 불이 붙었으며,[127] 모비에서는 4명이, 탄카라에서는 1명이 버스를 공격한 혐의로 체포되었다. 체포에 항의하는 집회가 [131][132][133]열렸다

하딕 파텔을 비롯한 5명의 PAAS 지도자들은 인도 형법 121조(정부와의 전쟁), 121A조(정부에 대한 형사력 사용), 124조(시드), 153-A조(각 지역사회에서 적대감을 조장), 120B조(정신), 153-B조(국가 청렴에 해가 되는 주장)에 따라 아메다바드 경찰에 입건됐다. 서라트 경찰은 청소년에게 자살하지 말고 경찰을 죽이라고 말한 혐의로 하딕 파텔을 시위 혐의로 입건했다.[134][135][136][137] 구자라트 고등법원은 10월 27일 하디크 파텔에 대한 항의시위를 기각했다.[138]

11~12월

2015년 11월 구자라트 전역에서 지방선거가 치러졌다. 몇몇 파티다르 지도자들은 집권 BJP 후보들에 대한 투표와 INC 후보들에 대한 지지를 촉구했다.[139] 선거 결과 도시 중산층인 패티다르가 BJP에서 INC로 대거 이주한 반면 도시 중산층인 패티다르는 BJP 투표를 계속한 것으로 나타났다.[139][12]

2016년 동요

1~3월

하딕 파텔이 여전히 감옥에 있고 여러 가지 혐의를 받고 있는 가운데, PAAS는 Sidsar, Jamnagar를 시작으로 Kagvad에서 절정을 이루는 Saurastra의 11개 구역에 걸쳐 33일 동안 Ekta Yatra(유니티 행진)를 조직했다.[140][141] SPG는 OBC와의 대립을 피하기 위해 EBC(경제적 후진 등급) 쿼터에 따른 예약을 요구했다.[142]

구자라트 입법회의 예산 회의 중 55개의 INC MLA가 시위를 지지하는 구호를 제기하고 재무부 벤치와 장관을 향해 막대사탕을 던지면서 의장에 의해 중단되었다.[143]

4월

쟈트 보호 운동 이후, 하리아나 정부는 쟈트 공동체의 예약 요구를 받아들여 또 한 차례의 동요를 일으켰다. 니틴 파텔이 위원장을 맡은 7인 위원회는 타협점을 찾지 못했고, 비탈 라다디야 BJP MP는 2차 협상을 벌였다. 수랏에 본부를 두고 다이아몬드 산업계 인사들로 구성된 새로운 조직인 파트다르 상흐도 결성되었다.[144] 그들은 그 동요로 죽은 12명의 파티다르 족의 친족에게 각각 3 라흐의 보조금을 발표했다. 그들은 또한 파티다르 지도자들이 감옥에서 석방되는 것을 지지하는 상징적인 단식을 조직했다.[1] PAAS와 SPG는 그들의 요구를 제시했다. 하딕 파텔과 다른 패티다르의 지도자들은 계속해서 법적 혐의를 받고 있으며 감옥에 있다. 패티다르는 2016년 4월 17일 개봉을 위해 '제일 바로 안돌란'(Fill The Cours Shird)을 시작했다.[145] 시위 허용은 거부되었고, 구청은 144조에 따라 금지 명령을 내렸지만,[146] 시위자들은 그 명령을 무시했다. 시위대가 메흐사나에서 경찰과 충돌하면서 이 시위는 폭력적으로 변했다. 약 25명의 시위자와 5명의 경찰, 그리고 2명의 공무원들이 충돌로 부상을 입었다. 메흐사나에는 통행금지가 부과되었다. 아메다바드, 메흐사나, 수랏, 라즈코트 등에서는 모바일 인터넷 서비스가 중단됐다. 피해 도시에는 신속처리반 소속 4개 업체가 배치됐고 중앙예비경찰대(CRPF) 소속 10개 업체는 중앙정부로부터 요청받았다. 체포되는 사람도 있었다. 수라트의 바라차 지역에서도 충돌이 있었다.[147][148] 일부 파티다르 단체들은 주 전체의 반드(스트라이크)를 요구했다. 한 파티다르의 지도자가 수라트에서 자살했다.[149]

구자라트 정부는 교육기관과 일자리 상위 계층 중 경제 후진학급([C]EBC)에 10%의 예약을 발표했다. (그러나 아래를 참조)[150][151]

5월~8월

하딕 파텔은 2016년 7월 15일 주 외 6개월, 메흐사나 외 9개월을 조건으로 보석 허가를 받았다.[152] 7월 29일, 구자라트 정부는 패티다르 지역 주민을 상대로 제기한 438건 중 391건을 철회할 것이라고 발표했다.[8] 아난디벤 파텔 주총리는 나이를 이유로 사임했지만 언론은 동요 대처가 그녀의 이유 중 하나라고 추측했다.[153][154][155][156] 8월 4일, 구자라트 고등법원은 10% EBC 보호구역이 위헌이며 대법원의 지침을 위반했다는 이유로 이를 파기했다.[150] 정부는 8월 9일 대법원에서 이 명령에 이의를 제기했다.[157] PAAS의 다른 지도자들은 하딕 파텔이 자신의 개인적 이익을 증진시키기 위해 지역사회의 돈을 쓴다고 비난했다.[158]

9~12월

파티다르는 아미트 샤 BJP 사장과 신임 장관 비제이 루파니가 지난 9월 7일 수라트에서 파티다르 지역사회의 44개 BJP MLA를 중죄하기 위해 개최한 행사를 보이콧하고 방해했다.[159][160] 사흘 뒤 루파니가 참석한 자스단 탈루카 앳코트 마을과 바브나가르BJP 총재의 중죄 행사가 차질을 빚었다. 26명의 시위자들이 앳콧에 억류되었고 11명은 바브나가르에 수감되었다.[161] 시위대를 폭행한 혐의로 경찰 7명도 나중에 입건됐다.[162] 9월 30일 바브나가르에서 열린 집회는 경찰이 PAAS 지도자들을 구금하면서 취소되었다.[163] 앞서 EBC예약에 따라 신규입학이나 채용을 불허하는 중간 지시를 내린 대법원에 해당 사건이 있어 EBC예약조례가 10월[D] 4일 폐지됐다.[164]

몇몇 파티다르 지도자들은 BJP의 지방선거에 반대표를 던지라고 요청했었다. 2016년 11월 27일에는 구자라트 16개 지구에서 126석 규모의 지방선거가 열려 2개 자치구와 1개 탈카판차야트 및 각종 기초단체 100석 이상의 재보선이 실시되었다. BJP는 109석을 얻은 반면 INC는 지난 선거보다 39석이 줄어든 17석을 얻었다.[165][166]

11개 PAAS 위원들은 2016년 12월 1일 3개 국무장관이 참석한 가운데 회담을 갖고 이들의 요구를 논의했다.[167]

2017~2020년 동요

그 동요는 2017년과 2018년에도 계속되었다. PAAS는 이 요구에 동의한 2017년 구자라트 국회의원 선거에서 INC의 캠페인을 지지했다.[168][169] 몇몇 파티다르의 지도자들 또한 BJP와 협력했다.[170] BJP는 의회에서 과반수 득표로 당선됐지만 2012년 이전 선거 결과보다 낮은 성적을 거뒀다. INC는 의석을 늘렸다. INC는 2018년 3월 민간회원 예약 청구서를 가져왔으나 부결됐다.[171][172]

2018년 8~9월 하딕파텔은 예약을 요구하며 19일간 단식을 했다.[173] 2018년 12월, 그는 INC 지도자들에게 입법부에서 민간 의원 법안을 다시 가져와 줄 것을 요청했었다.[172]

인도 의회는 2019년 1월 14일 시작된 제103차 헌법 수정안을 통과시켜 사회경제적 약자구간(EWS)에 최대 10%까지 유보했다. 그 개정안은 대법원에서 이의를 제기하고 있다.[174][175] 구자라트 정부는 같은 날 시행을 발표했다.[176] 2019년 3월 12일 하딕 파텔은 INC에 입사했다.[177] 2020년 8월 103차 개정에 도전한 사건을 심리 5인 재판관 체제로 회부했다.[178]

반응

사교적인

일부 패티다르의 지도자들과 단체들은 하딕 파텔과 그의 전술 그리고 그의 조직인 PAAS를 비난했다.[7][85][179][180][181][182][183][184][185] 1000명이 넘는 파텔이 미국 뉴저지 에디슨에서 모임을 갖고 SPG가 주도하는 동요에 대한 지지를 확대했다.[186]

브라만, 타코르, 바이슈나바, 라즈푸트, 신디, 칸사라, 소니, 라후반시 등 몇몇 다른 구자라트 공동체의 지도자들 또한 비슷한 노선을 따라 예약 운동을 시작했다.[187][188][189] 우타르프라데시하리아나자트 커뮤니티는 예약 요구가 20여 년 전으로 거슬러 올라가지만 2015년 9월부터 같은 방식으로 동요를 시작하겠다고 발표했다.[50]

구자르 비카스 교단, 쿠르미크샤트리아 마하사바, 안자나-차우드하리 사마즈, 라쉬트리야 구자르 만치 등 다른 지역사회 단체들도 이 운동에 지지를 아끼지 않았다.[50]

이미 OBC 지위가 있는 지역사회의 지도자들은 이 운동에 반대했다. OBC Ekta Manch와 Gujarat Kshatya Takor Sena는 8월 23일 아메다바드와 라지코트에서 수천 명이 참석한 반격 시위를 벌였다.[190][191][192] OBC 에크타 만치도 9월 19일 맞불집회 프라티카르 집회 허가를 요청했으나 당국은 법과 질서 상황을 이유로 허가를 거부했다.[99][193]

2015년 9월 14일, 안드라 프라데시 기반 조직인 아그라 쿨라 이키아 베디카(Agra Kula Ikya Vedika)는 브라만, 카트리야, 비시아, 캄마, 레디, 벨라마, 카푸 커뮤니티 대표 등이 참석한 가운데 비제이와다에서 만나 카스트와 종교가 아닌 경제적 지위에 따른 예약을 요구했다. 이들은 또 중앙정부에 이 문제를 연구하기 위해 대법원 판사를 위원장으로 하는 위원회를 구성할 것을 요청했다.[194]

2016년 9월 마하라슈트라에서 마라타에 대한 예약 운동이 격화되었다.[195]

운동은 예약, 카스트 제도, 카스트 정치, 투표 은행 정치, 구자라트 전역과 인도 전역의 청년들의 교육 비용 및 실업률 증가 등에 대한 논쟁을 촉발시켰다.[196][197][198][199][200][201]

정치

2015년 8월 11일, 구자라트 장관 아난디벤 파텔은 7명으로 구성된 위원회를 구성하여 지역사회와 교류하고 정부에 보고서를 제출하였다. 니틴바이 파텔이 이끄는 패널에는 라만랄 보라, 부펜드라신 추다사마, 바부바이 보키리아, 바수벤 트리베디, 나누바이 바나니, 라즈니 파텔 등도 포함됐다.[22] 8월 17일 위원회는 SPG를 포함한 지역사회 단체들과 회담을 가졌다. PAAS는 회담에 참가하지 않았다.[30][46][202][203][204] 8월 21일과 23일, 정부는 법적, 헌법적 한계를 주장하는 구자라티 주요 신문에 전면 광고를 게재했다.[47][192] 수상은 헌법상의 한계를 들어 패티다르를 OBC 범주에 포함시킬 수 없음을 표명하고, 선동가들에게 협상을 촉구했으나, 그들은 그 요구를 거절했다. 8월 25일 아흐메다바드에서 열린 집회에서 폭력사태가 발생하자 그녀는 유감을 표명하고 조사를 지시했으며 주 내의 평화와 질서를 요구했다.[57] 위원회는 9월 9일에 보고서를 제출했고 9월 14일에 두 번째 회담이 열렸다.[92][205] 9월 17일 그녀는 다시 국가의 계급 갈등을 피하기 위해 그 동요의 종식을 촉구했다.[6] 9월 19일 그녀는 폭력이 두 번째로 일어났을 때 내각과 다시 만났다.[193] 9월 25일 그녀는 일반 학생들을 위한 묵히야 맨트리 유바 스왈람반 제도를 발표했는데, 이 계획은 연간 1,000 크로어의 재정이 소요될 것으로 예상된다.[206]

8월 26일 나렌드라 모디는 대화를 통한 평화와 해결을 호소했다.[207]

지난 8월 26일 시작된 구자라트 입법회의 몬순 회기 동안 야당인 인도국민회의(INC)는 8월 25일 집회에 이어 경찰의 만행에 대한 수사를 요구했다. 의장은 세 차례 집회를 중단했고, 야당 지도자인 샨케르신 바겔라를 제외한 모든 INC MLA를 하루 동안 중단시켰다.[2] 바겔라는 BJP가 예약 정책을 검토하기 전에 예약을 제공한 근거가 없는지 확인해야 한다고 말했다.[208] 10월 1일, INC의 Gurudas Kamat 사무총장은 이 운동에 대한 지지를 발표했고, 사회의 경제적 약자 구역(EWS)에 15-20%의 인구에 대한 전국적인 예약을 요구했다.[120]

날린 코트디야, 다리의 BJP MLA, 사바르칸타 MP 딥신 라토드 등이 선동 지지 선언을 했다.[210][211] 나인 코트디야는 이후 2015년 10월 선거에서 INC에 투표할 것을 유권자들에게 촉구했다.[212] 구자라트 마드하브신 솔랑키 전 총리는 이번 소요사태가 오래가지 못할 것이라고 말했다.[16] 케슈바이 파텔 전 총리는 이 운동이 비폭력이라면 지지를 표명했다.[91]

일부 언론은 니티쉬 쿠마르 비하르 총재가 선동과의 연대를 표명했다고 보도했으나 그는 이후 이를 부인했다.[213][214][215] 샤라드 야다브는 선동자들의 요구를 부당하다며 일축할 것을 권고했고, 선동 배경은 일자리 부족이라고 말했다.[215][216] 라훌 간디 INC 하원의원은 모디 정부를 비난하고 "분노의 정치"의 반향이라고 말했다.[217] 8월 28일 파드라의 6개 회사들은 동요를 지지하여 사임했다.[218] 아암 아드미 당은 선동자들에 대한 경찰의 조치와 선동자들에 의한 공공 재산 파괴를 비판하는 성명을 발표했다.[219] 인도 공산당(마르크시스트)은 폭력과 경찰의 행동을 비난했다.[220] Biju Janata Dal MP Baijayant Panda는 패티다르 공동체의 불안은 전국적으로 일자리가 부족하기 때문에 정당하다고 말했다.[221]

라쉬트리야 스웨이엄세바크 상흐모한 바그왓 대표는 예약의 실효성에 대한 검토를 제안했다.[110] 만모한 바이다야 국가대변인은 RSS 정기 간행물 사드나와의 인터뷰에서 역사적 부정을 근거로 SC와 ST에 주어진 예약을 지지한다고 말하면서도 하딕 파텔의 언행과 분열적 전술에 대해 비판했다.[222]

구자라트 정부는 2015년 10월부터 11월까지 5년 임기가 끝나는 지방 자치단체의 선거를 연기하기 위한 두 개의 조례를 통과시켰다. 이 지방 자치 단체들은 253개의 자치 단체, 208개의 탈루카 판차야트, 26개의 지역 판차야트 그리고 6개의 지방 자치 단체들을 포함한다. 구자라트 고등법원은 나중에 조례를 파기했다.[223][224]

사법적

구자라트 고등법원은 지난 8월 25일 폭력사태가 발생하자 경찰과 구자라트 정부에 수사통지서를 발부하고 경찰의 재산피해 및 잔학행위에 관한 보고서를 제출했다.[2] 아흐메다바드에서 청소년이 보호자 사망할 경우 법원은 국가범죄수사국(CID)에 수사를 지시했다.[73] 파티다르 폭력조직의 수뇌부 역할로 사법위원회의 조사를 받으려는 필이 법원에 접수됐다.[225] 고등법원은 주 정부에 폭력으로 사망한 사람의 친족에 대한 보상금 4 라크, 장애를 입은 사람의 65% 이상에게는 2 라크, 경찰의 잔혹행위로 부상한 사람에게는 1만 라크를 지급하라고 명령했다.[226][227] 2015년 8월 말 발생한 인터넷 서비스 전면 금지 등을 요구하는 공익소송이 고등법원에 접수됐다.[228] 나중에 법원은 인터넷 금지에 대한 정부의 결정을 지지했다.[229] 구자라트 고등법원도 9월 16일 경찰 일부에 대해 FIR 제소를 명령했다.[230][231] 법원은 2015년 10월에도 여러 파티다르 지도자에 대한 사건을 심리했다.[133]

구자라트 고등법원은 지방 자치 단체 선거 연기 조례가 위헌이라고 주장하며 이를 파기하고 중앙 선거관리위원회에 12월 25일까지 선거를 치르도록 지시했다.[223][224]

10% EBC 예약에 대한 청원이 제기되자 2016년 8월 구자라트 고등법원에 의해 위헌이라는 이유로 파기환송됐다.[150] 정부는 이 명령에 이의를 제기하는 대법원으로 이동했다.[232][233] 대법원은 EBC예약에 따라 신규입학이나 채용을 불허하는 중간 지시를 내렸다. EBC 예약에 대한 조례가 10월 4일에 발효되었다.[164]

이 동요를 소재로 한 영화 '파티다르의 힘'이 영화진흥위원회(Central Board of Film Certification)로부터 허가를 받지 못했다.[234]
