레즈비언, 게이, 양성애자, 성전환자(LGBT)의 권리는 유럽 국가별로 매우 다양하다.세계적으로 동성결혼을 합법화한 32개국 중 19개국이 유럽에 있다.추가로 11개의 유럽 국가들은 동성 커플에 대한 시민 연합이나 더 제한적인 형태의 인정을 합법화했다.

몇몇 유럽 국가들은 어떠한 형태의 동성 결합도 인정하지 않는다.결혼은 아르메니아, 벨라루스, 불가리아, 크로아티아, 그루지야, 헝가리, 라트비아, 리투아니아, 몰도바, 몬테네그로, 러시아, 세르비아, 슬로바키아, 우크라이나 헌법에서 남녀 간의 결합으로 정의된다.그러나 이들 중 크로아티아, 헝가리 및 몬테네그로는 동성 파트너십을 인정하고 있으며[a], 아르메니아는 해외에서 [1][2]동성결혼을 인정하고 있다.동유럽은 서유럽보다 더 적은 법적 권리와 보호, 더 나쁜 생활 조건, 그리고 성소수자에 대한 지지 여론을 가지고 있는 것으로 보인다.

결혼을 허용하는 모든 유럽 국가들도 동성 커플에 의한 공동 입양을 허용한다.시민 조합만 있는 나라들 중에서 안도라를 제외하고는 아무도 공동 입양을 허용하지 않으며, 절반만이 양부모 입양을 허용한다.

2011년 성소수자 권리에 대한 유엔 총회 선언에서 각국은 이 주제에 대해 지지, 반대 또는 기권을 표명할 기회가 주어졌다.유럽 국가들의 대다수가 지지를 표명했다.오직 카자흐스탄만이 반대 의사를 표명했다.기권을 표명한 국가는 아제르바이잔, 벨라루스, 러시아, 터키였다.

2020년 12월 헝가리[3][4]헌법 내에서 동성 커플의 입양을 명시적으로 금지했고, 2021년 6월 헝가리 의회는 러시아 '동성애 반대 선전법'[5]과 유사한 '성 재배치 또는 동성애를 묘사하거나 조장하는 내용'을 미성년자에게 보여주는 것을 금지하는 법을 승인했다.13개 EU 회원국[6] 법이 유럽연합 기본권 헌장의 위반이라며 비난했다.

ILGA-유럽에 따르면 LGBT 평등 측면에서 상위 3개 유럽 국가는 몰타, 벨기에[7][8]룩셈부르크이다.서유럽은 종종 성소수자들이 살기에 세계에서 가장 진보적인 지역 중 하나로 여겨진다.

역사

고대 그리스, 로마, 이교도 켈트 사회에서 동성 관계는 꽤 흔했지만, 기독교가 로마 제국의 공식 종교가 된 이후 동성애 행위에 대한 엄격한 법이 나타났다.390년 테오도시우스 1세 황제의 칙령은 모든 "수동적인" 동성애자들을 공공의 불에 태워 죽이라고 규탄했다.이것은 529년 유스티니아누스 1세의 말뭉치 쥬리스 시빌리스가 뒤따랐는데, 이것은 적극적이고 수동적인 파트너인 동성애 행위를 저지른 모든 사람들에 대한 공개 거세 및 처형을 규정했다.소도미라고 불리는 동성애 행위는 대부분의 유럽 국가들에서 사형으로 간주되었고, 수천 명의 동성애 남성들이 지난 수 세기 동안 유럽 전역에서 박해의 물결 속에서 처형되었다.레즈비언들은 처벌 대상으로 지목되는 경우가 적었지만,[9] 그들은 또한 때때로 박해와 처형을 당하기도 했다.

966년 폴란드가 건국된 이래 폴란드 법은 동성애를 [10]범죄로 규정한 적이 없다.1795년 폴란드가 독립한 지 40년 만에 분할된 폴란드 영토에서 러시아, 프러시아, 오스트리아의 소도미 법이 시행되었다.폴란드는 1918년에 독립을 되찾았고 점령국의 [11][12][13]법을 버렸다.1932년 폴란드는 동성애자와 이성애자의 동등한 동의 연령을 [14]15세로 규정했다.

터키에서 동성애는 [15][16]1858년부터 합법화 되었다.

프랑스 혁명 동안, 프랑스 국회는 동성애에 대한 모든 언급을 생략한 채 1791년 형법을 개정했다.나폴레옹 전쟁 동안, 동성애는 네덜란드와 통일 전 독일의 많은 국가들과 같이 프랑스의 통제 하에 있는 영토에서 처벌이 해제되었다. 하지만, 독일에서는, 프러시아가 오랫동안 동성애를 가혹하게 처벌했기 때문에, 이것은 프러시아 카이저 치하의 국가의 통일로 끝이 났다.1942년 8월 6일, 비시 정부는 보수적 의제의 일환으로 21세 미만과의 동성애 관계를 불법으로 규정했다.대부분의 비시 법률은 전쟁 후 폐지되었다.그러나 동성애자 금지법은 1982년 8월 마침내 폐지될 때까지 40년 동안 명부에 남아있었다.그때 동의 연령(15)이 다시 이성애자 및 동성애 파트너에게도 동일하게 되었다.

그럼에도 불구하고, 동성애자들과 레즈비언들은 1969년 현대 동성애자 권리 운동이 시작될 때까지 20년 동안 유럽 전역에서 이성애자 사회의 도덕적, 사회적 반대가 강하게 남아 있었기 때문에, 계속 비밀스러운 삶을 살았다.

20세기 독재정권 하의 여러 나라들은 소련, 나치 독일, 프란시스코 프랑코 정권 하의 스페인 등 매우 반동성애적이었다.반면 폴란드는 제1차 세계대전 이후 독립한 뒤 1932년 20세기 유럽에서 동성애 행위를 비범죄화한 두 번째 국가가 됐다(러시아 소비에트 연방 사회주의 공화국 시절 1917년 비범죄화했다가 1933년 스탈린 시절 재범죄화했다).1933년 덴마크, 1940년 아이슬란드, 1942년 스위스, 1944년 스웨덴.

1956년 독일민주공화국은 동성애를 [17]불법화한 독일 형법 175항을 폐지했다.1962년 체코슬로바키아에서 동성애 행위는 다른 남자와의 성관계를 포기하고 이성결혼을 확립한 것으로 보이는 동성애 남성들의 남근측정법을 포함한 Kurt Freund의 과학적 연구에 따라 범죄에서 제외되었다.프로인드는 동성애 성향은 바꿀 수 없다는 결론에 도달했다.그러나, 체코슬로바키아에서 동성애 행위의 비범죄화 이유가 남성에게만 있다는 주장은 여성에게도 적용된다는 사실과 모순된다. 동성애자의 권리에 대한 주장으로서 남성 특유의 고정성의 개념은 여성의 성적 유연성의 개념과 결합되어 있기 때문이다.레즈비언 [18][19]권리로요

1972년 스웨덴은 성전환 수술을 허용하고 호르몬 대체요법을 무료로 제공하는 [20]것을 법으로 허용한 세계 최초의 국가가 되었다.

1979년, 스웨덴에서는 동성애가 질병으로 분류되는 것에 항의하여 많은 사람들이 동성애자라는 사례를 들어 병가를 냈습니다. 뒤를 이어 전국보건복지위원회 본청에서 활동가들이 점거했다.몇 달 만에 스웨덴은 동성애를 [21]질병으로 규정한 유럽 최초의 국가가 되었다.

아일랜드에서는 2011년부터 시민 파트너십이 합법화되었습니다.2013년, 정부는 동성 커플에게 혼인 권리를 확대하기 위한 헌법 개정안을 압도적으로 찬성하는 제헌대회를 열었다.2015년 5월 22일 아일랜드 시민들은 "결혼은 성별에 구애받지 않고 법에 따라 계약할 수 있다"는 헌법 개정을 위한 투표를 했다. 유권자의 62.1%가 개정안에 찬성함으로써 아일랜드는 전 세계적으로 NAT을 통해 동성결혼을 도입한 첫 번째 국가가 되었다.이온 국민 투표아일랜드의 첫 동성 결혼식은 2015년 [47]11월에 열렸다.

맨섬[48]2011년부터 시민 파트너십을 허용했으며,[49] 2012년에는 저지 도 허용했습니다. 왕실은 2016년[50] 7월 22일 이후,[51] 2018년 7월 1일부터 동성결혼을 합법화했다.

리히텐슈타인은 2011년 [52]국민투표를 통해 유권자의 68%가 등록된 파트너십을 합법화했다.

2012년 1월 1일 집권당인 피데스당의 지도자인 빅토르 오르반 정부에 의해 제정된 헝가리의 새로운 헌법이 발효되어 이성 커플에 대한 결혼을 제한하고 성적 [53]성향에 따른 차별으로부터 보호받을 수 있는 보장이 없다.

2012년 영국 정부는 잉글랜드와 웨일스에 적용되는 법을 바꾸려는 의도로 동성결혼 [54]공개 상담을 시작했다.결혼 법안은 2013년 7월 17일에 법안으로 통과되었다.스코틀랜드 정부는 2015년까지 동성결혼을 합법화하는 것을 목표로 비슷한 협의를 시작했다.2014년 2월 4일 스코틀랜드 의회는 동성결혼을 합법화하고 배우자가 성전환 파트너에게 법적 [55]성별을 변경할 수 없도록 허용하는 배우자 거부권을 폐지하는 법안을 통과시켰다.동성결혼은 2019년 10월 21일 북아일랜드로 확대되었고 이 법은 2020년 1월 13일부터 시행되었다.

2013년 5월 프랑스는 동성결혼을 합법화했고 프랑수아 올랑드 프랑스 대통령은 동성결혼과 [56]동성결혼을 허가하는 법에 서명했다.

2013년 6월 30일 블라디미르 푸틴 러시아 대통령은 러시아 성소수자 선전법을 발효시켜 국가 두마에서 승인했다.이 법은 미성년자들 사이에서 "전통적이지 않은" 성관계를 지지하는 선전을 하는 것을 [57]범죄로 규정하고 있다.

2013년 12월 1일 크로아티아에서 국민투표가 실시되어 결혼은 남성과 여성의 결합으로 헌법상 정의되었다.투표는 65.87%의 지지와 37.9%[58]의 투표율로 통과되었다.

2014년 1월 27일 북키프로스 터키공화국에서 터키계 키프로스 대리인들은 새로운 [59]형법으로 동성애 행위를 5년 이하의 징역으로 처벌하는 식민지 시대의 법을 폐지하는 개정안을 통과시켰다.

2014년 4월 14일 몰타 의회동성 커플을 인정하고 아이를 입양할 수 있도록 허용하는 시민연합법에 찬성표를 던졌다.같은 날 몰타 의회도 성적 성향과 성 정체성에 따른 차별을 금지하는 헌법 개정안에 찬성표를 던졌다.

2014년 6월 4일 슬로바키아 의회동성결혼 금지를 위한 헌법 개정을 찬성 102명, 반대 18명으로 압도적으로 승인했다.이는 이 헌법 제정을 위한 헌법 개정 요건 150명 중 2/3(재임 의원 100명 이상)을 충족시켰다.임시 [24]수정

2014년 6월 18일 룩셈부르크 의회는 동성결혼과 [60]입양을 합법화하는 법안을 승인했다.이 법은 7월 17일 관보에 게재되었고 2015년 [61][62][63]1월 1일부터 시행되었다.

2014년 7월 15일 크로아티아 의회는 동성 커플에게 [64]입양을 제외한 모든 권리를 부여하는 생명 동반자법을 통과시켰다.그러나 이 법은 부모의 평생 반려자가 자녀의 보호자가 될 수 있도록 허용하고 있다.기관으로서의 파트너-후견인 자격은 권리와 책임에서 의붓자녀 입양과 동일하지만 부모의 평생 파트너에게 부모의 지위를 부여하지는 않습니다.이성 커플의 동반자-후견인 자격과 양부모 입양 기준은 같다.또한, 파트너-후견인에 관계없이, 부모의 라이프 파트너는 법정 또는 부모 및 라이프 파트너 간의 합의를 통해 아이에 대한 부분적인 부모 책임을 얻을 수 있습니다.심지어 법원이 그것이 아이에게 가장 이익이 된다고 판단하는 경우에도 마찬가지입니다.

2014년 9월 덴마크에서는 트랜스젠더에게 엄격한 정신의학적 평가와 거세를 의무화하던 기존의 관행을 사실상 폐지하고 법적 성별 변경이 허용되었다.6개월의 대기기간 후 성별 변경요구에 대한 성명서 및 후속 확인만 요구하면 전문가 평가나 다른 공식적인 제한 [65]없이 법적 성별 표시를 변경할 수 있습니다.한편 벤트 호이에 노르웨이 보건장관은 노르웨이에도 비슷한 법이 [66]곧 마련될 것이라고 약속했다.그리고 2016년 3월 18일, 정부는 16세 이상의 사람들에 의한 어떠한 형태의 정신 또는 심리 평가, 진단 또는 어떤 종류의 의료 개입도 없이 합법적인 성별 변경을 허용하는 법안을 도입했다.6세에서 16세 사이의 미성년자들도 부모의 [67][68][69]동의 하에 그러한 가능성을 가질 수 있다.그 법안은 6월 [70][71]6일 의회에서 79대 13의 투표로 승인되었다.그것은 6월 17일에 공포되었고 2016년 [69][72]7월 1일에 발효되었다.

2014년 10월 9일 에스토니아 의회는 40 대 38의 표로 [73]동거 법안을 통과시켰다. 협정은 같은 날 토마스 헨드리크 일베스 대통령이 서명하여 2016년 [74]1월 1일부터 발효되었다.

2014년 11월 27일 안도라 의회는 동성 파트너의 공동 입양을 합법화하는 시민 연합 법안을 통과시켰다.2014년 12월 24일 프랑수아 올랑드 공자가 두 공신 중 한 명의 서명이 필요하다고 공표한 후 공식 저널에 이 법안이 발표되었습니다.2014년 [75]12월 25일에 발효되었다.

2014년 12월 12일 핀란드 의회는 101 대 90의 [76]투표로 동성결혼 법안을 통과시켰다.이 법은 2015년 2월 20일 사울리 니니스퇴 대통령에 의해 서명되었다.기본법의 조항이 완전히 시행되기 위해서는 더 많은 법률이 통과되어야 한다.이 법은 2017년 [77]3월 1일부터 시행되었다.

2015년 1월 북마케도니아의 의회는 결혼을 남녀 [78]간의 결합으로 규정하는 법안을 통과시켰다.1월 9일 국회 헌법위원회는 앞서 언급한 결혼 제한과 결혼, 가족 및 시민 조합의 미래 규제에 대한 3분의 2의 추가적 요구(이전에는 주권과 같은 문제만을 위한 요구)를 포함한 일련의 개정안을 승인했다.(법률 질문)1월 20일, 개정안은 72 대 4로 의회에서 승인되었다.그러나 이 개정안이 헌법에 추가되기 위해서는 최종 표결이 필요했다.이 마지막 국회는 1월 26일에 시작되었지만 여당 연합이 필요한 3분의 2의 과반수를 얻지 못했기 때문에 끝내 끝나지 않았다.국회 개헌은 2015년 말까지 휴회돼 개헌이 [79]무산됐다.

2015년 2월 7일, 슬로바크스는 동성결혼과 동성부모 [80]입양을 금지하는 국민투표를 실시했다.주민투표 결과는 [81]각각 95%, 92%의 찬성으로 금지안을 제정하는 것이었다.그러나 주민투표는 투표율이 [82]낮다는 이유로 주민투표법상 무효로 간주됐다.

2015년 3월 3일 슬로베니아 의회는 51대 28로 [83]동성결혼 법안을 통과시켰다.2015년 12월 20일 슬로베니아인들은 새로운 동성결혼 법안을 63% 대 37%로 부결시켰다.

2015년 11월 키프로스 의회는 39 대 12의 표결로 동성 커플을 위한 시민 결합을 [84]합법화하는 법안을 승인했다.2015년 [85][86]12월 9일부터 시행되었다.

그리스에서 동성 커플을 위한 시민 결합을 합법화하는 법안은 2015년 12월 194 대 55의 [87]표결로 의회에서 승인되었다.이 법은 대통령에 의해 서명되어 2015년 [88]12월 24일에 발효되었다.

2016년 4월 29일 페로 제도 의회는 종교적 의식에서 합법적으로 결혼할 가능성을 제외하고 덴마크 동성 결혼법을 영토로 확대하는 법안을 통과시켰다.덴마크 의회는 교회가 [89][90]동성 간의 결혼을 할 수 있는 덴마크와는 달리 페로 제도의 종교적 결혼 제외를 여전히 승인해야 했다.페로 제도 내의 법은 덴마크 의회와 왕실 모두의 비준 절차를 거쳐 2017년 7월 1일부터 발효되었다.

2016년 5월 13일 이탈리아 의회는 동성 커플을 위한 시민 결혼을 합법화하는 법안을 승인했다.이 법은 2016년 [91]5월 20일 대통령에 의해 서명되었다.이는 5월 21일 관보에 게재되었고,[92] 이에 따라 2016년 6월 5일부터 시행되었다.

2016년 9월 21일 건시 주는 동성결혼을 합법화하는 법안을 찬성 33표,[93][94] 반대 5표로 승인했다.2016년 12월 14일 왕실 승인을 받았다.이 법은 2017년 7월 1일부터 시행되었다.

2016년 10월 26일 지브롤터 의회는 만장일치로 동성결혼을 허용하는 법안을 통과시켰다.2016년 [95]11월 1일 왕실 승인을 받았다.이 법은 2016년 12월 15일부터 시행되었다.

2017년 1월 31일 이탈리아 대법원은 절차상의 이유로 프랑스 노르드파드칼레 지역에서 집행된 두 프랑스 여성(이들 중 한 명은 이탈리아 국적을 주장할 권리가 있다) 간의 결혼을 인정하는 하위 판결을 취소하는 것을 거부했다.이탈리아에서 동성결혼이 인정된 것은 이번이 처음이지만, 이번 판결로 인해 반드시 일반적인 [96]경우가 될 것이라고는 할 수 없다.

2017년 10월 유럽 평의회 의회는 33명의 의원들이 찬성표를 던진 후 유럽 정부간 기관으로부터 최초의 이성간 특정 결의안을 채택했다.결의안은 의학적으로 불필요한 성관계 정상화 수술, 멸균 및 기타 치료의 금지를 요구함으로써 이성간 사람들에게 신체적 자율권과 신체적인 무결성에 대한 권리를 요구했다.각료위원회는 결의안을 각료회의에 제출할 것을 권고하고 있다.이들 국가의 정부에는 심리사회적 지원의 필요성이 있으며 정책입안자들에게 "반(反)차별적 법률이 효과적으로 적용되고 이성간 [100][101]사람들을 보호할 것"을 요구하고 있다.

2017년 12월 5일, 오스트리아 헌법재판소는 동성결혼 금지를 위헌으로 판결했다.동성 [102][103]결혼은 2019년 1월 1일부터 합법화 되었다.

2018년산마리노 의회는 의붓자녀 입양권을 [104]가진 시민 조합을 합법화하기 위해 투표를 했다.시민 조합을 허용하는 법은 여러 가지 법적 및 행정적 변화를 거쳐 2019년 2월 11일 완전히 시행되었다.

2019년 12월 18일 유럽의회[105][106]폴란드에 있는 80개 이상의 LGBT 자유구역을 463대 107로 규탄했다.

2020년 12월 18일 국가평의회와 국무원이 모두 전술한 합법화를 승인한 후 2021년 9월 26일 스위스 유권자의 3분의 2가량이 선택 [107][108]국민투표에서 시민결혼과 동성 커플의 자녀 입양권을 합법화하는 것에 동의했다.새로운 법은 2022년 [109][110][111]7월 1일부터 시행된다.

Z przeprowadzonej powyżej analizy prac nad Konstytucją RP wynika jednoznacznie, że zamieszczenie w art. 18 Konstytucji RP zwrotu definicyjnego "związek kobiety i mężczyzny" stanowiło reakcję na fakt pojawienia się w państwach obcych regulacji poddającej związki osób tej samej płci regulacji zbliżonej lub zbieżnej z instytucją małżeństwa. Uzupełniony tym zwrotem przepis konstytucyjny "miał pełnić rolę instrumentu zapobiegającego wprowadzeniu takiej regulacji do prawa polskiego" (A. Mączyński, Konstytucyjne podstawy prawa rodzinnego, s. 772). Innego motywu jego wprowadzenia do Konstytucji RP nie da się wskazać (szeroko w tym zakresie B. Banaszkiewicz, "Małżeństwo jako związek kobiety i mężczyzny", s. 640 i n.; zob. też Z. Strus, Znaczenie artykułu 18 Konstytucji, s. 236 i n.). Jak zauważa A. Mączyński istotą tej regulacji było normatywne przesądzenie nie tylko o niemożliwości unormowania w prawie polskim "małżeństw pomiędzy osobami tej samej płci", lecz również innych związków, które mimo tego, że nie zostałyby określone jako małżeństwo miałyby spełniać funkcje do niego podobną (A. Mączyński, Konstytucyjne podstawy prawa rodzinnego, s. 772; tenże, Konstytucyjne i międzynarodowe uwarunkowania, s. 91; podobnie L. Garlicki, Artykuł 18, w: Garlicki, Konstytucja, t. 3, uw. 4, s. 2, który zauważa, że w tym zakresie art. 18 nabiera "charakteru normy prawnej").
