예멘에서 사형은 법적 처벌이다.

예멘은 [1][2]1인당 사형 집행률이 세계에서 가장 높은 나라 중 하나이다.사형은 일반적으로 [3]총격을 가하고 때로는 공공장소에서 행해진다.예멘 대통령은 관대한 처분을 내릴 권한을 가진 유일한 개인일 뿐만 아니라,[4] 집행되기 전에 법원에서 내려진 모든 사형 집행을 승인해야 한다.

법적 절차

사형수 범죄

사형에는 살인, 강간, 테러와 같은 폭력 행위가 포함되지만, 사형은 이론적으로 간통, 성적 비위, 음탕, 매춘, 신성모독,[3][14] 배교와 같은 이슬람이나 "후두드" 범죄에도 사용될 수 있다.납치, 폭력 강도, 마약 밀매, 도적질, 죽음으로 이어지는 재산 파괴, 특정 군사 범죄(예: 비겁함, 탈영), 잘못된 처형, 간첩 및 반역죄도 사형 선고를 받을 수 있습니다.[3][15]

방법들

총살은 현재 예멘에서 사용되는 유일한 사형 집행 형태이다.돌팔매질, 교수형, 참수는 예멘 [16]형법에서도 허용되지만 돌팔매질은 [3]수세기 동안 행해지지 않은 것으로 알려져 있다.

예멘에서는 피고인을 바닥에 엎드린 뒤 담요로 덮는 것이 사형 집행의 기본 절차다.이후 자동소총으로 무장한 소수의 경비원들이 피살자의 심장에 여러 발을 쏘고(흔히 척추뼈를 파괴한다) 형을 집행한다.[17][18]피고인이 후두드 추가 범죄로 유죄 판결을 받은 경우,[19] 사망 전에 채찍질도 선고될 수 있습니다.예멘에서는 [18]사형과 공개 사형이 모두 허용된다.

비판

예멘에서 미성년자에 대한 마지막 공식 처형은 1993년 7월 21일 13세의 나세르 나세르 나세르 알-키르비와 다른 3명의 남성이 살해와 [20][21]노상강도 혐의로 수도 사나에서 교수형에 처해졌다.에 따라 예멘 하원은 이듬해 [22]형법을 개정해 18세 이하에 대한 사형선고를 금지했다.그러나 대다수의 예멘인은 출생증명서를 발급받지 않고 있으며(2006년 세계보건기구([23]WHO)에 따르면 22.6%의 민간 출생등록률을 기록), 예멘의 법체계는 범죄 [3]당시 피고인의 나이를 충분히 확인할 수 있는 능력이 심각하게 제한돼 있다.예멘에서 [4][24][25][26]소년 범죄자들이 계속 처형되고 있다는 보고가 몇 건 있다.특히 주목할 만한 사례 중 하나는 Ibb 출신 Muhammed Taher Thabet Samoum의 경우로, 그는 1999년 6월에 저질러진 살인으로 기소되어 [27]2001년 9월에 사형을 선고받았다.그의 형량은 최고법무위원회에 의해 확정되었고 알리 압둘라 살레 [28]대통령이 승인했다.사모움은 [25]범행 당시 13세였던 것으로 알려졌으며,[25] 그의 사형 임박 사건은 2011년 2월 예멘의 인권 상황에 관한 유럽의회 결의에서 특히 강조되었다.
