2022년 5월 2일, 폴리티코사무엘 알리토 대법관이 작성한 다수 의견 초안을 공개했는데, 폴리티코는 이 내용의 진위를 확인했다고 밝혔습니다.[3]그 의견 초안은 다수가 보유하고 있다면 로 대 웨이드, 계획된 부모 대 케이시를 뒤집을 것이고 그렇게 해서 그 형태로 최종 확정될 것입니다.알리토의 결정문 초안은 낙태가 미국 헌법에 보호권으로 명시돼 있지 않고, 대신정부가 미국 헌법 수정 제10조에 따라 낙태 제한이나 보장을 결정할 수 있도록 한다는 이유로 로 결정을 "처음부터 터무니없이 잘못된 것"이라고 규정했습니다.[3][5]
